Purpose : In this study, the main issues of the Model Law on Electronic Transferable Records (MLETR) were analyzed, and by examining the current status of implementation by international organizations and countries, a plan was derived for use in Korea's e-trade service. Research design, data, methodology : I conducted literature research, including reports of major international organizations and advanced countries, and analyzed the current situation with data cooperation from global solution and service providers. So far, the MLETR has been enacted in 7 countries, and ICC and G7 are actively pursuing their own legislation and pilot projects based on it. started. Results : A legalization of the MLETR suitable for Korea and the application of e-trade services were proposed. From the legal point of view, it was recommended to revise the e-B/L Regulations of the Commercial Act, which are the existing laws for e-B/L, and the Electronic Trade Promotion Act, which is the core of e-trade services. And as a way to utilize the e-trade service, it was recommended to implement a service model by combining the e-B/L registration management system and u-TradeHub service. For future research tasks and development plans, domestic legalization of MLETR and field-oriented pilot verification have been suggested, and the upgraded e-trade service is expected through this.

본 연구는 전자양도성기록 모델법(MLETR)의 주요 쟁점을 분석하고 국제기구 및 국가별 추진 현황을 파악함으로 우리나라 전자무역 서비스의 적용방안을 도출하였다. 주요 국제기구 및 선진국가들의 보고서 등 문헌연구를 하였으며 글로벌 솔루션 및 서비스 제 공자들로부터 자료 협조를 얻어 현황을 분석하였다. 지금까지 전자양도성기록 모델법은 7개국 가에서 법제화가 되었고 ICC, G7 등에서 자국의 법제화와 이를 기반으로 하는 시범사업을 적 극적으로 추진 중에 있으며 글로벌 솔루션 제공자들은 MLETR 기반의 파일럿 프로젝트를 통 한 서비스를 제공하기 시작하였다. 이를 토대로 하여 우리나라에 적합한 MLETR의 법제화 및 전자무역 서비스 적용방안을 제안 하였다. 법적인 측면에서는 MLETR의 강력한 적용 대상인 전자선하증권의 기존 법령인 상법 전자선하증권 규정과 전자무역 서비스의 핵심 근간이 되는 전자무역 촉진법의 개정을 권고하 였다. 그리고 전자무역 서비스 적용방안으로는 전자선하증권 등록관리시스템과 u-TradeHub 서 비스를 결합하여 전자무역 서비스 모델을 구현하는 것으로 제안하였다. 향후 연구과제와 발전방안에 대해 MLETR의 국내 법제화 및 현장 중심의 시범검증을 제안하 였고 이를 통해 업그레이드된 전자무역 서비스를 기대한다.
