The Marine Safety Act stipulates standard measures as administrative actions to prevent and secure safety of marine-specific hazards because the risks caused by the specific nature of the marine environment are not easy to predict compared to land and can cause enormous human and property damage if not properly prepared. The term “navigation safety measures" means ordering the captain or shipowner to change the passage time, change the route, etc. if the chief of the Coast Guard Station deems it necessary to secure the safety of the navigation when large ships, dangerous cargo carriers, and high-speed passenger ships that have poor steering performance compared to other ships. In order for navigation safety measures to be properly implemented, specific standards for detailed measures must be prepared, and methods to ensure the effectiveness of the implementation of the measures must be stipulated. The provisions of standard measures for safe navigation should be reorganized in maritime-related legislation, and legal readjustment of administrative entities is necessary so that safe navigation measures can be practically implemented.

해사환경의 특수성에 기인한 위험은 육상과 비교하였을 때 예측이 쉽지 않고 이 를 적절하게 대비하지 않으면 막대한 인적·재산적 피해를 초래할 수 있기 때문에 해 상 고유의 위험을 예방하고 안전을 확보하기 위한 행정작용으로서의 표준조치가 󰡔해 사안전법󰡕에 규정되어 있다. ‘항행안전조치’는 다른 선박에 비하여 조종성능이 좋지 않은 거대선, 위험화물운반 선, 고속여객선 등이 교통안전특정해역을 항해하려는 경우에 해양경찰서장이 항행의 안전을 확보하는 데 필요하다고 인정하면 선장이나 선박소유자에게 통항시각의 변경, 항로의 변경 등 지정된 사항을 명령하는 것을 말한다. 항행안전조치가 제대로 이루어지기 위해서 세부적인 조치사항에 대한 구체적 기 준이 마련되어야 하고, 조치이행에 대한 실효성이 확보될 방법이 규정되어야 한다. 해사 관련 법제에 안전항행을 위한 표준조치 조항이 정비되어야 하고, 항행안전조치 가 실제적으로 이루어질 수 있도록 행정주체에 대한 법률적인 고려가 필요하다.
