Recently, the number of disputes in the franchise business is also rapidly increasing, which is a structural reality that disputes are bound to exist due to conflicting performance relationships between the franchise headquarters and franchisees from the stage of conclusion of the franchise contract to the implementation of the contract and the termination of the contract. In this context, this study focused on alternative dispute resolution methods as an effective alternative rather than the existing compulsory dispute resolution procedures (court judgments) in relation to franchise dispute resolution procedures; 1) Expansion of the proactive dispute resolution system 2) Expansion of alternative dispute resolution procedures (ADR, ODR, etc.) such as arbitration and mediation 3) Preliminary dispute resolution procedures (DRB-DisputeReview/Resolution Board, Dispute Resolution Board) 4) In-depth research on collective dispute resolution. Taking this study as a cornerstone, future research is expected to conduct more advanced research from the point of view of franchise disputes, contributing to dispute resolution, and conducting active research on specific measures that can provide practical help to the concerned parties.

최근 가맹사업에서의 분쟁의 횟수 또한 급격하게 늘고 있는데 이는 가맹계약의 체결단계에서 부터 계약의 이행 및 계약의 종료에 이르기까지 가맹본부와 가맹점사업자는 상반된 이행관계로 인해 분쟁이 존재할 수 밖에 없는 것이 구조적 현실이다. 이러한 맥락에서, 본 연구는 가맹사업 분쟁해결 절차와 관련하여 기존의 강제적 분쟁해결절차(법원판결)가 아닌 실효적인 대안으로서 의 대체적 분쟁해결 방법 중심으로 살펴보았고 그 주요 내용은 1) 사전적 분쟁해결제도 확대 2) 중재 및 조정 등 대안적 분쟁해결 절차(ADR, ODR 등) 확대 3) 사전적 분쟁해결 절차 (DRB-DisputeReview/Resolution Board, 분쟁해결위원회), 4) 집단분쟁조정에 관한 심층연구를 수행하였다. 본 연구를 초석으로 향후 연구에서는 가맹사업 분쟁이라는 관점에서 더욱더 진일보 된 연구가 수행되어 분쟁해결방안에 기여할 수 있고 해당 당사자들에게도 실질적 도움을 줄 수 있는 구체적 방안에 관한 활발한 연구가 수행되기를 기대한다.
