This study aims to examine some problems with handling procedures to school violence and to suggest alternative approaches to the exclusive organization of school violence. Although the process of solving the school violence has the goal of protecting victims and educating and leading the perpetrators of school violence in accordance with the School Violence Prevention Act, the actual case handling process has strengthened the punishment of the perpetrators and deepened the conflict between the parties to school violence. It was intended to look back on the problems of the school and to suggest improvement measures through an internal and external approaches. There are two major problems with the current organization of school violence. Such is the limitation in terms of content and operation of the organization dedicated to school violence. The main contents of the problem include the fact that, despite the wide range of school violence, legal forms and procedures were enforced at the school site, resulting in the loss of the school’s dispute mediation function, and the prevention of school violence due to the task of dealing with issues in which it is difficult to restore the relationship between school members. However, it does not contribute to the restoration of trust. As an alternative method to solve these problems, first, there is an internal school approach. For example, ‘recovery support team in school’ or ‘revitalization of the existing life guidance committee’ should be established. Second, it is an out-of-school approach. It is to establish a ‘school violence specialized center’ under the School District, focusing on recovery rather than punishment for unresolved issues within the school. Lastly, it is necessary to form a crisis coping team that can help professionally resolve conflicts in schools to help form the school culture without violence.

본 연구는 학교폭력예방법 상 학교폭력 전담기구의 사안처리 절차가 피해자 보호와 가해자의 교육 과 선도라는 목표를 갖고 있으나, 실제 사안처리 과정은 가해학생에 대한 처벌을 강화하고 학교폭력 당사자 간 갈등을 심화시켜 온 점에 대한 문제점을 살펴보고 학교 내⋅외부적인 접근 방식으로 개선 점을 제시해 보고자 하였다. 현행 학교폭력 전담기구 사안처리 절차의 문제점은 크게 두 가지이다. 이는 학교폭력의 범위가 넓 은데 비해 법적인 형식과 절차를 학교 현장에서 강행하여 학교의 분쟁 조정 기능을 상실했다는 점과 학교 구성원 간 관계 회복이 어려운 사안처리 절차로 학교폭력의 예방이나 신뢰 회복에 기여하지 못한 다는 점이다. 이를 해결하기 위한 대안적 방안으로는 첫째, 학교 내부적인 접근 방식이 있다. 예를 들면, ‘회복지 원팀의 도입’ 또는 기존의 ‘생활지도위원회의 활성화’를 시도하고 이를 통해 관계 회복적인 교육 제도 를 도입하는 것이다. 둘째, 학교 외부적인 접근 방식이다. 교육지원청 산하에 기존의 위센터와 같은 ‘학교폭력전문센터’ 등을 전문적으로 두고, 학교 내에서 해결이 안된 사안들의 처벌보다 관계 회복에 초점을 맞추어 상담, 교육 등의 지원을 하도록 하는 것이다. 이러한 대안적 해결방안은 현재의 학교폭 력 전담기구 사안처리에서의 문제점을 극복하고 폭력없는 학교문화 형성에 기여할 수 있을 것이다.
