In the past five years, crimes related to children and adolescents have been steadily increasing, and similar crimes are occurring in succession. The School Violence Prevention Act of 2020 and the Child Abuse Punishment Act of 2021 have been revised with stronger punishment, but the legislation is not the fundamental solution. The legislation is only the beginning of solving the problem. We monitor the law enforcement process and take part in the campaign that will change the consciousness of crimes related to children and adolescents. The achievements of the legislation will be effective when it is followed. Therefore, this study will be looking at the process of crimes related to children and adolescents and the transition process of the legal system, and try to be pointed out the future tasks after the legislation through the examples of developed countries. And I would like to emphasize the ‘public debate and politicization of violence’ on the serious issues of child abuse and school violence. Also, I insist that the government should establish the Ministry of Children and Youth, and the National Assembly and political parties should establish the Committee on Children and Youth, independent of the fields of women, health, welfare, and education, and then the human rights and welfare of children and young people be the first task of government.

최근 5년간 아동청소년 대상 범죄는 꾸준히 증가하고 있고, 심지어는 이전 사건을 채 수습하기도 전에 연 이어 유사 범죄가 발생하고 있다. 2020년 학교폭력예방법과 2021년 아동학대처벌법이 신고 및 처벌 등이 강화되어 개정되었지만 입법화 되었다고 해서 그 문제가 근본적으로 해결되는 것은 아니다. 법률의 제·개정 은 어디까지나 문제해결의 시작에 불과하다는 인식을 가지고 시대와 시기, 사회적 상황 등을 정책 변화에 반 영함과 동시에 해외의 정책 변화에도 지속적인 관심을 가지고 시사점을 얻을 수 있어야 할 것이다. 따라서 본 연구에서는 아동청소년 대상 범죄 관련 정책의 변화를 살펴보면서 해외 사례를 통하여 입법화 이후 향후 과제를 짚어보고자 한다.
