Most people think it’s obvious that we have a right to procreate and raise children. In fact, many people think reproductive rights are among the most important rights we have. After all, reproductive rights protect some of the most intimate acts between adults and many people think that rearing children is the greatest source of meaning and fulfillment in life. At the same time, most of us think there are some situations where the government is justified in taking away someone’s children. Cases of extreme neglect or abuse come to mind – cases where people have demonstrated that they are not fit parents. If it’s okay to take someone’s children away after the fact, could it ever be okay to deny them the right to raise children beforehand? One way of denying parents the opportunity to raise children would be to require them to procure a license to parent in the same way we require licenses to drive a car or own a handgun. Many would find this surprising, but perhaps there is a good argument for licensing parents. In Hugh Lafollette’s paper, “Licensing Parents” he talks about the need for government licensing of parents. His argument states that for any activity that is harmful to others, requires competence, and has a reliable procedure for determining competence, should require licensing by the government. This argument relates to parenting because it can be harmful to children, requires competence to raise those children, and we can assume that a reliable procedure can be formulated. In this paper, I decided to weigh Hugh Lafollette's 1980 and 2010 parental licensing theories and related papers. It is important to establish a more positive child-rearing attitude because the parent-rearing attitude also affects the actual child-rearing behavior. From the beginning, there is no perfect parent for child support, only parents striving to be perfect. Therefore, Hugh Lafollette's allegations of limited parental licensing also appear to provide key policy implications for the proactive prevention of child abuse.

일반적으로 아동학대의 대응정책은 아동학대발생이전의 사전예방정책과 아동학대발생 이후의 사후조 치(학대의 발견, 개입 및 보호)로 구분할 수 있으며, 이러한 두 가지의 정책은 어느 일방이 아니라 상호협 력하며 조화롭게 실시되어야 아동학대의 근절이라는 목표에 더욱 다가갈 수 있다. 하지만 종래의 대부분 의 아동학대예방정책 등을 살펴보면 사전예방정책보다는 발생 이후의 사후조치에 역점을 두고 있는 것으로 보인다. 물론, 아동학대의 속성 중의 하나인 피해의 중대성과 지속성 등을 감안한다면 아동학대 가 발생한 이후의 적극적인 신고와 이에 따른 신속한 개입 등은 발생 이후에 더욱 심각해질 수 있는 중대한 피해방지를 위하여 매우 중요하다. 다만, 이미 학대행위가 발생한 후에 실시되는 개입정책이라는 점에서 아동학대의 근본적인 대책으로서는 한계가 있다. 따라서 아동학대의 근본적인 해결을 위해서는 학대행위가 발생한 경우에의 적절한 개입과 함께 아동학대의 발생을 사전에 억제할 수 있는 정책 또한 매우 중요하다. 이러한 아동학대의 사전예방과 관련하여 LaFollette의 1980년과 2010년의 부모의 자격화론은 아동학 대의 사전예방의 필요성을 강조하였다는 점에서 의의가 있다. 특히 2010년의 LaFollette의 한정적인 새로 운 접근방식은 1980년의 부모의 자격화론을 대체하는 것이지만 부모의 자격화론을 포기한 것은 아니다. 즉, 방법론적인 부분에는 차이가 있으나 부모에 대한 제약을 최소화하는 방법으로 충분히 아동학대를 사전단계에서 예방할 수 있는 제도의 구축이라는 목적을 달성하고자 하고 있다. 따라서 부모는 아동을 소유할 자연적인 권리가 있다는 것을 포기하여야 하며, 부모의 역할은 아동이 올바른 성인으로서 성장할 수 있도록 그들의 삶을 확보하여야 한다는 점을 강조한다는 점에서는 양자가 공통된다. 본 연구에서는 LaFollette의 1980년과 2010년의 부모의 자격화론과 관련된 논문에 대해서 비교검토하 였다. 부모의 양육태도는 실제로 아동을 양육하는 행동에도 직접적인 영향을 미치기 때문에 보다 긍정적 인 양육태도를 확립하는 것이 중요하다. 따라서 아동학대의 사전예방을 위하여 부모의 양육태도와 행동 의 변화를 위한 교육의 필요성을 생각한다면 2010년의 논문에서 LaFollette의 학대예방을 위한 주장은 매우 의미가 있다고 생각한다. 처음부터 아동양육에 완벽한 부모는 존재하지 않으며 다만 완벽할 수 있도록 노력하는 부모가 있을 뿐이라는 점을 고려한다면 2010년 LaFollette의 한정적 부모의 자격화에 대한 주장 또한 아동학대의 사전예방을 위한 주요한 정책적 시사점을 제공하고 있다.
