Marine accident investigation and maritime crime investigation using ships have no choice but to rely on statements from witnesses or accident officials because there is no recorded objective evidence such as CCTVs or black boxes. Therefore, there should be evidence to support the statements of witnesses or accident officials, such as navigation records, ship logs, communication details, and VDRs in which conversations between crew members in the steering room are recorded, and a system to accurately analyze and reproduce such evidence is needed. There are electronic video screening systems and ship control simulation systems to analyze accident investigation and navigation information when marine accidents such as collision, fire, sinking, and grounding during ship operation, and Korea Coast Guard use the ship collision reproduction system developed through the National R&D project. This paper studied in-depth the analysis technique for submitting it as legal evidence, focusing on the precedent of special coercion case adopted as evidence by using the ship collision reproduction system, which was mainly used for marine accident investigation such as ship collision after introduction by Korea Coast Guard. In order to increase the accuracy of navigation analysis and utilization of Korea Coast Guard investigations for various and complex ship accidents and ship crimes in the future, additional studies on the operation and navigation characteristics of the most common occurrence fishing boats are needed.

해양사고 조사 및 선박을 이용한 해양범죄 수사는 CCTV나 블랙박스 등 녹화된 객관적인 증거자료가 없기 때문에 목격자나 사고관계자의 진술에 의지할 수밖에 없 는 실정이다. 그래서 운항 항적이 저장되어 있는 항해기록장치나 항박일지, 통신내역, 조타실 내 선원 간 대화가 기록된 VDR 등 목격자나 사고관계자의 진술을 뒷받침할 수 있는 증거자료가 있어야 하며, 이런 항해기록장치 등의 증거자료를 정확하게 분 석하고 재현하는 시스템이 필요하다. 선박운항 중 충돌, 화재, 침몰, 좌초 등의 해양사고가 발생했을 때 사고조사 및 항 해정보를 분석하기 위해 전자영상심판시스템, 선박조종시뮬레이션 등의 시스템이 있 으며, 해양경찰에서는 국가R&D 사업을 통해 개발된 선박충돌재현시스템을 사고선 박 조사에 활용하고 있다. 본 논문은 해양경찰에서 도입 후 선박충돌과 같은 해양사고 조사에 주로 활용하 던 선박충돌재현시스템을 선박범죄 분석에 활용하여 재판에서 증거로 채택된 특수강 요죄 판례를 중심으로 고찰하면서, 법정증거로 제출하기 위한 분석기법을 심층적으 로 연구하였다. 향후 다양하고 복잡한 선박사고 및 선박범죄에 대한 항적분석 정확도와 해양경찰 수사의 활용도를 높이기 위해서는, 가장 많이 발생하는 어선의 운항 및 항적특성에 대한 연구가 추가적으로 더 필요할 것으로 판단된다.
