When it comes to enforcing labor-related laws, land workers and seafarers have been typically considered to be completely separate groups from one another. This is because general labor-related laws have been limitedly applied to seafarers due to the heavy emphasis on the peculiarity of seafarers’ labor generally governed by the unique Seafarers Act. The minimum wage system constitutes the basic labor right guaranteed to all types of workers by the Constitution. However, to seafarers, the Minimum Wage Act does not apply; the minimum wage regulations specified in the Seafarers Act apply instead. The Seafarers Act has only one provision relevant to the minimum wage for seafarers, and the specific details regarding the minimum wage for seafarers refer to the Ministry of Oceans and Fisheries’ directives and announcements. Due to this structure, it has been pointed out that the minimum wage system for seafarers is inadequate, and the determined minimum wage level for seafarers lacks legitimacy. This situation, in particular, is closely related to the problem of discriminatory minimum wages for foreign seafarers. There should be greater attention and efforts to improve the minimum wage system for seafarers, at least from now on, as it lagged behind that for land workers. The rationality of the system should be enhanced by legislating the criteria to determine the minimum wage for seafarers while making the system more acceptable by engaging stakeholders. In order to solve the problem of discrimination against foreign seafarers in terms of minimum wage payment, it is necessary to systematically organize the norms of the Seafarers Act related to the minimum wage. It should be noted that the peculiarity of the Seafarers Act should be sufficiently considered during the process of developing and implementing measures to improve the minimum wage payment for seafarers.

그동안 최저임금제도를 포함한 노동관계법령 적용에 있어서 육상 근로자와 선원 근로자는 완전히 분리된 집단으로 인식되어 온 경향이 있다. 이는 일반적인 노동관계법령이 선원 근로자에게 제한적으로 적용되고 독자적인 선원법제가 구축되면서 ‘선원 노동의 특수성’이 강조되어 왔기 때문이다. 최저임금제도는 헌법에 명시된 노동기본권으로 모든 근로자에게 보장된다. 하지만 선원 근로자에게는 ｢최저임금법｣이 적용되지 않으며, ｢선원법｣의 최저임금에 관한 규정이 적용된다. 선원법은 선원 최저임금에 관한 하나의 근거 조문을 두고 있을 뿐 구체적인 내용은 모두 해양수산부 고시로 위임하고 있다. 이러한 구조로 인하여 선원 최저임금제도의 체계가 미흡하고, 결정 선원 최저임금액의 정당성이 부족하다는 지적이 제기되고 있다. 특히, 외국인 선원에 대한 최저임금 차별 적용문제는 이러한 상황과 밀접하게 연결되어 있다. 지금부터라도 육상 근로자의 최저임금제도에 비하여 상대적으로 느리게 발달해 온 선원 최저임금제도를 개선하기 위한 관심과 노력이 필요하다. 결정 기준의 법제화를 통하여 합리성을 제고하고, 이해 관계자들의 적극적인 참여를 통해 수용성을 높이는 방안이 마련되어야 한다. 외국인 선원에 대한 최저임금 차별 문제 해소를 위하여 최저임금과 관련된 선원법 규범의 체계적 정리도 필요하다. 주의할 점은 개선방안을 결정하고 시행하는 전 과정에 있어서 선원법제의 특수성이 충분히 고려되어야 한다는 점이다.
