Adolescents are recognized as subjects of rights, not simply objects of protection. In the process of continuous development of the youth welfare system, such a viewpoint refers to the youth as the subject of fulfillment of social welfare needs, not the existing viewpoint. This means the realization of rights, and it also means a power that satisfies the right to social welfare benefits. This study examined the extent to which the right to participate among these rights of youth is being realized in Korea. Specifically, the ordinances related to the youth council of metropolitan local governments were selected as the subject of study, and the level of youth participation was examined. As a result of the study, ordinances related to youth councils are being operated in a total of six metropolitan local governments in Korea, The local ordinances made it clear that they not only functioned as the basis for the establishment and operation of the youth council, but were also operated as part of democratic citizenship education. However, due to the short history of the youth council, the youth did not directly participate in local community issues or the specific policy-making process was not revealed through the ordinance. Most of the regions were also a one-time program. In the future, in order to promote youth participation rights through the activation of youth councils, it seems that more efforts should be made to create an environment where policies in which young people can actually participate in the local community can be made.

청소년은 단순히 보호의 대상이 아닌 권리의 주체로 인식되고 있다. 이와 같은 관점은 청소년 복지 제도의 지속적인 발전 과정에서 기존의 대상자로서의 관점이 아니라 사회복지 욕구의 충족의 주체로서의 청소년을 의미한다. 이는 권리의 실현을 의미하는데 사회복지급여권이라는 것을 충족시키는 하나의 권력을 의미하기도 한다. 본 연구에서는 이와 같은 청소년의 권리 중에서 참여권이 어느 정도로 우리나라에서 실현되고 있는지 살펴보았다. 구체적으로 광역 지방자치단체의 청소년 의회와 관련한 조례를 연구 대상으로 선정하여 청소년의 참여권이 어떠한 수준인지 고찰하였다. 연구 결과 우리나라에서는 총 6개의 광역 지방자치단체에서 청소년 의회 관련 조례가 운영되고 있고 아동친화도시 조성에 관한 조례 내용을 실현하기 위해 규칙으로 운영되는 지역도 있었다. 해당 지자체의 조례들은 청소년의회 설치 운영의 근거로 기능할 뿐만 아니라 민주주의 시민 교육의 일환으로 운영되고 있다는 것을 분명히 하고 있었다. 하지만 청소년의회의 역사가 짧은 탓에 직접 청소년이 지역사회 문제에 참여하거나 구체적인 정책결정과정이 조례를 통해 나타나지는 않았다. 일회성 프로그램으로 그치는 지역 또한 대다수였다. 앞으로 청소년 의회의 활성화를 통한 청소년의 참여권을 증진하기 위해서는 지역사회에서 실제로 청소년이 참여하는 정책이 만들어 질 수 있는 환경 조성에 더욱 노력하여야 할 것으로 보인다.
