The purpose of this study is to clarify the methodological meaning of Oliver and Shaver’s jurisprudential approach in terms of solving the value dilemmas. The jurisprudential approach is often simply understood as a technical dimension of legal reasoning due to the strong association of the wording. However, it should be remembered that the jurisprudential approach was advocated in terms of citizenship education. The character of jurisprudential approach as a citizenship education becomes clear when considering how to solve the value dilemmas. In this paper, three main points were discussed. First, by comparing the perspectives of Myrdal, Oliver and Shaver on the value dilemmas, which is called an ‘American dilemma’, a unique perspective of jurisprudential approach was identified. The reason that Oliver and Shaver set the value dilemmas as a contention of general values in the public sphere is interpreted to lay the foundation for rational judgment through democratic discourse. Next, the position of jurisprudential approach as a method of solving the value dilemmas was identified. The jurisprudential approach is identified as an alternative approach that embraces both the universalism on the value of human dignity and the relativism in the interpretation of human dignity. Finally, the social meaning of jurisprudential approach was examined. The process of value judgment based on human dignity which is assumed in the jurisprudential approach can be understood as a methodology that promotes the balance between the rule of law and democracy. Through the above discussion, it was attempted to establish a theoretical foundation that could be recognized as a comprehensive and interdisciplinary methodology for cultivating democratic citizenship beyond the meaning of legal mind or reasoning.

본 연구의 목적은 Oliver와 Shaver의 법리적 접근에 대해 그 방법론적 의미를 가치 딜레마 해결의 차원에서 새롭게 밝히는 데에 있다. 법리적 접근은 용어의 강한 연상으로 인해 기술적 차원의 법적 논증으로 단순하게 이해되는 경우가 많다. 그러나 법리적 접근은 시민성 교육의 차원에서 주창된 것이라는 점이 상기되어야 한다. 시민성 교육으로서 법리적 접근의 면모는 가치 딜레마를 해결하는 방법을 고찰할 때 뚜렷하게 드러난다. 본고는 크게 세 가지의 논의를 진행하였다. 우선, ‘미국의 딜레마’로 일컬어지는 가치 딜레마에 대한 Myrdal, Oliver와 Shaver의 관점을 비교하여 법리적 접근에서 가치 딜레마를 이해하는 독특한 관점을 확인하였다. Oliver와 Shaver가 가치 딜레마를 공적 영역에서의 일반 가치들의 경합으로 설정한 이유는 민주적 담화를 통한 합리적인 판단이 가능한 토대를 마련하기 위한 것으로 해석된다. 다음으로, 가치 딜레마 해결 방식으로서 법리적 접근의 위치를 확인하였다. 법리적 접근은 인간의 존엄성에 대한 보편주의 관점과 이의 해석에 대한 상대주의 관점을 모두 포섭하는 대안적 접근이라는 점이 확인된다. 마지막으로, 법리적 접근의 사회적 의미를 고찰하였다. 법리적 접근에서 상정하는 인간의 존엄성에 터한 가치 판단의 과정은 법치주의와 민주주의의 균형을 도모하는 방법론으로 이해될 수 있다. 이상의 논의를 통해, 법리적 접근이 법적 사고 혹은 논증의 의미를 넘어 민주 시민성 함양을 위한 종합적이고 학제적인 방법론으로 인식될 수 있는 이론적 토대를 마련하고자 하였다.
