Although the undercover investigation system was officially introduced into the investigation procedure in Korea for the first time due to the revision of the Youth Sexual Protection Act, it is limited in that it can be applied only to digital sex crime investigations targeting children and juveniles. In this regard, we intend to examine the problems of the system through comparative law studies. As a result of a comparative legal review of the undercover investigation systems of the UK and Germany, which represent the Commonwealth and Continental legal circles, both countries recognize undercover investigations as a basic activity for crime prevention and investigation, and almost all major crimes. It has a characteristic that the law specifies procedural requirements in order to prevent abuse of authority and establish a legal basis for the use of undercover investigations for prevention and investigation. Referring to the policy implications drawn from the cases of the UK and Germany, the directions for improving the identity disguise investigation system in Korea are as follows. First of all, the Korean-style undercover investigation is divided into two groups, namely, identity nondisclosure investigation and identity disguise investigation. It is necessary to add the area of undercover investigations with undisclosed identity, and it is reasonable to abolish the procedural restrictions on general investigations on undisclosed identity. In addition, it is necessary to expand the types of crimes to which undercover investigations can be applied. It is not appropriate to expand the system to the general administrative investigation area other than criminal investigation due to concerns about invasion of privacy. It is necessary to expand the undercover investigation system to investigate serious crimes such as drug crimes and organized crimes.

청소년성보호법의 개정으로 위장수사제도가 우리나라의 수사절차에 공식적으로 처 음 도입되었지만, 위장수사를 신분비공개수사와 신분위장수사로 구분하고 아동과 청소 년 대상 디지털 성범죄 수사에만 제한적으로 적용할 수 있다는 점이 한계로 설정되어 있어 비교법적 연구를 통해 제도의 문제점을 살펴보고자 한다. 영미법계와 대륙법계를 대표하고 있는 영국과 독일의 신분위장수사시스템에 대한 비교법적 검토를 진행한 결과, 두 나라 모두 위장수사를 범죄예방과 수사를 위한 기본 적인 활동으로 인식하고 있으며 거의 모든 중요범죄의 예방과 수사를 위해서 신분위장 수사를 이용할 수 있도록 법적 근거를 두고 권한의 남용을 방지하기 위하여 절차적 요 건을 법률에 명시하고 있다는 특징을 가지고 있다. 영국과 독일의 사례에서 도출된 정 책적 시사점을 참고하여 우리나라 신분위장수사제도 개선방향을 살펴보면 다음과 같 다. 우선 한국형 위장수사는 신분비공개수사와 신분위장수사의 두 그룹으로 분류하고 있는데, 여기에 신분 비공개 잠입수사의 영역을 추가할 필요가 있으며, 일반적인 신분비공개수사에 대한 절차적 제한요건을 폐지하는 것이 타당하다. 또한 신분위장수사가 적용될 수 있는 범죄의 유형을 확대할 필요가 있다. 신분위장수사제도는 사생활침해에 대한 우려가 있어 범죄수사 이외에 일반적인 행정조사 영역으로 확대하는 것은 적절하 지 않지만 최소한의 필수 영역인 범죄수사 분야에서는 승인 및 허가절차, 수사기간, 사 후적통제수단 등을명확히규정한다는 것을 전제로 마약범죄, 조직범죄 등중대범죄의 수사를 위해 신분위장수사제도를 확대해 나아갈 필요가 있다.
