We don't know when the era of level 5 fully autonomous driving will come when cars drive freely without drivers. However, Level 3 cars are already being released, and Level 4 cars are expected to be released after five to six years. Under these circumstances, the 「Road Traffic Act」, which will come into effect on April 20, 2022, is evaluated to be very insufficient in terms of the 'duties and responsibilities' of autonomous vehicle drivers. As a result, it is difficult to secure traffic safety and it seems that there will be many difficulties in the law enforcement work of police officers. Therefore, the National Police Agency proposes to revise and supplement the relevant regulations in the 「Road Traffic Act」as follows as soon as possible. First, the definition of drive & autonomous vehicle driver should be newly established. Second, the mandatory regulations for autonomous vehicle drivers should be supplemented. Specifically, it is mandatory to check whether the conditions for using the autonomous driving system have been met before starting driving, check the installation and normal status of the autonomous driving information recording device, prohibit forgery and modulation, and store and submit driving records (data). Third, police officials should be given the authority to check and inspect the records of the 'autonomous driving information recording device.

운전자 없이 자동차가 스스로 자유롭게 주행하는 Level 5 수준의 완전 자율주행 시 대는 언제 올지 모른다. 그런데 Level 3 수준의 자동차는 이미 출시되고 있고, Level 4 수준의 자동차는 5～6년이후 출시될 것으로 예상된다. 이런 상황 하에서 2022년 4월 20 일부터 시행되는 「도로교통법」은 자율주행자동차 운전자의 ‘의무와 책임’ 등에 관한 규제가 매우 미흡한 것으로 평가된다. 그로 인하여 교통안전 확보가 어렵고 또한 경찰 공무원의 법 집행 업무에도 많은 애로가 있을 것으로 보인다. 따라서 경찰청에서는 조속한 시일 내 「도로교통법」상 관련 규제를 다음과 같이 보완하여 개정할 것을 제안한다. 첫째, ‘운전자’와 ‘자율주행자동차운전자’의 정의를 신설해야 한다. 둘째, 자율주행자 동차운전자의 의무규정을추가 보완해야한다. 구체적으로는 운전시작 전에 자율주행 시스템 사용조건을충족했는지 여부를 확인해야할 의무, 자율주행정보기록 장치의 장 착 및 정상상태 확인, 위조 및 변조 금지, 운행기록(데이터)의 보관 및 제출의무이다. 셋째, 경찰공무원에게 ‘자율주행정보기록장치’의 기록을 확인·검사할 수 있는 권한을 부여해야 한다.
