The Private School Law Revisions passed by the 21st National Assembly on August 31, 2021 includes the stipulation that the private schools should establish a written examination as a process for the recruitment of teachers, and that the superintendent of education for each city or province should be in charge of these examinations. The official reason for these revision of the private school law about the recruitment of teachers is the elimination of private school corruption. However, this revision undermines the autonomy of private schools, which is a foundation of the identity of the private school. In order to solve the problem of private school corruption, the ministry of education or the office of education can use other methods to strengthen the function of supervision and inspection regarding the recruitment process of private schools. This revision breaks through the line of demarcation between the private and public sectors in education, which can verge on a violation of the constitutional rights of private schools. In particular, this revision of the private school law can cause a serious problem for religious schools including Christian schools. Religious schools are founded on the basis of a school philosophy that reflects religious underpinnings. In order to pursue this religious school philosophy, religious schools must be able to invite teachers who are in accord with the school’s religious values and perspectives. The recruitment of teachers is an important element in the realization of the founding philosophy of private schools. This revision of the private school law shakes the foundations of religious schools. This study focuses on an analysis of the problems created by the recent revision of the private school law, and searches for ways of response to this revision from the position of Christian schools. Finally, this study suggests several strategies for Korean churches and Christian schools to solve the problem, including a constitutional appeal.

지난 2021년 8월 31일에 국회 본회의를 통과한 사학법 개정안은 사 립 초·중등학교의 교원임용 시 필기시험을 포함하여야 하고 이를 시·도 교육감에게 위탁해야 한다는 내용을 담고 있다. 그 개정의 취지로서 사학 의 교원임용 관련 비리 척결을 내세우지만, 이 사학법 개정은 사립학교 교 원임용 과정에 대한 감독과 감사 기능을 강화하는 차원이 아니라 사립학교 존립의 본질적 요체라고 할 수 있는 교원임용의 자율성을 근본적으로 훼손 하고 있다. 이는 시·도교육감이 직접 사립학교의 교원임용이라고 하는 사 학 운영에 개입하여 통제력을 행사하는 위헌적 월권이라고 할 수 있다. 교원임용에 관한 필기시험을 교육감에게 강제 위탁하도록 한 사학법 개정은 특히 종교계 사립학교에 심각한 문제를 야기할 소지가 있다. 종교 계 사립학교는 종교적 건학이념에 근거하여 설립된 사립학교로서 그 설립 목적을 구현하는 것이 학교의 존립 이유인 학교이다. 이러한 목적 구현을 위해서는 종교적 건학이념에 동의하는 교사를 임용하여, 종교적 가치관에 입각한 교육을 실천하는 것이 중요하다. 종교계 학교에 있어서 교원임용은 학교의 건학이념을 구현하고 그 정체성을 지속하는 데 있어서 가장 중요한 요소라고 할 수 있는데, 이번의 교원임용 관련 사학법 개정은 이러한 종교 계 사학의 존립 기반을 흔드는 조치라고 할 수 있다. 본 연구는 이번 사립 학교 개정안 중 사립학교 교원임용의 시·도교육감 강제 위탁 법안의 문제 점을 살펴보고, 이에 대한 종교계 사학, 특히 기독교 사학의 비판적 입장을 기술하며, 향후 대응 방안을 제안하고 있다.
