The value of financial data is increasing day by day, and the demand to purchase or sell financial data is continuously increasing. Nevertheless, in the current legal system, the Financial Data Exchange is nothing more than a mail order brokerage. However, since financial data contains important information related to an individual's real-time financial industry, it is necessary to be very careful in handling it. Article 26-4 of the ｢Act on the Use and Protection of Credit Information｣ designates a 'data specialized agency' because financial data is of high value but poses a high security threat, and the appropriate data collection agency and anonymization process are evaluated. After receiving the information, financial data transactions are made. However, many operators are unaware of the existence of the Act, and anyone can operate a domestic financial data exchange by simply reporting a mail-order brokerage business in accordance with the ｢Consumer Protection Act in Electronic Commerce, Etc.｣ without a separate qualification for an exchange. Therefore, in this paper, after examining the current status and legal status of financial data exchanges, problems with the current financial data exchanges were pointed out. First, the absence of legal status on the financial data exchange; second, the opacity of financial data pricing; and third, the absence of incentives for financial data transactions. As an improvement plan, first, the separation of financial data exchanges from dataspecialized institutions Second, establishment of legal basis for financial data exchanges Third, the necessity of permission and reporting system of financial data exchanges Fourth, re-establishment of the role of data-specialized institutions, fifth, financial data The foundation for valuation of the financial data exchange was prepared, and sixth, the preparation of incentives for vitalization of the financial data exchange was presented. When the economic value of financial data is reasonably evaluated and the protection of personal information contained in financial data is safe from security threats, we are convinced that the financial data trading market will be activated.

금융데이터의 가치는 나날이 증가하고 있고 금융데이터를 구매하거나 판매하려는 수요는 계속적으로 증가하고 있다. 그럼에도 불구하고 현행 법체계에서 금융데이터거 래소는 통신판매중개업자의 지위에 지나지 않는다. 그러나 금융데이터는 개개인의 실 시간 금융산업과 관련한 중요한 정보가 포함되어 있어 이를 취급함에 있어 상당히 주 의할 필요가 있다. ｢신용정보의 이용 및 보호에 관한 법률｣ 제26조의4는 금융데이터가 가치가 높지만 보안위협이 크다는 점 때문에 ‘데이터전문기관’을 지정하고 데이터전문 기관에게 정보집합물의 결합 및 익명처리의 적정성 평가를 받은 뒤 금융데이터거래가 이루어지도록 하고 있다. 그러나 동법의 존재에 대해 모르는 사업자가 많고 국내 금융데이터거래소는 거래소 에 대한 별도의 자격없이 ｢전자상거래 등에서의 소비자 보호에 관한 법률｣에 따라 통 신판매중개업 신고만 하면 누구나 운영이 가능한 상황이다. 이에 본 논문에서는 금융데이터거래소 현황과 법적 지위를 살펴본 뒤, 현행 금융데 이터 거래소의 문제점을 지적하였다. 첫째, 금융데이터거래소 법적 지위의 부재, 둘 때, 금융데이터 가격 결정의 불투명성, 셋째, 금융데이터거래 유인책 부재이다. 이에 대한 개선방안으로 첫째, 금융데이터거래소와 데이터전문기관의 분리 둘째, 금 융데이터거래소의 법적 근거 마련 셋째, 금융데이터거래소의 허가·신고제의 필요성 넷째, 데이터전문기관 역할의 재정립, 다섯째, 금융데이터에 대한 가치평가 기반 마련, 여섯째, 금융데이터거래소의 활성화를 위한 유인책 마련을 제시하였다. 금융데이터의 경제적 가치가 합리적으로 평가되고 금융데이터에 포함된 개인정보 보호가 보안위협으로부터 안전할 때 금융데이터거래 시장은 활성화될 것을 확신한다.
