Institutions are necessary to provide an orderly social interaction among individuals. To impose order, institutional constraints must be enforced, and enforcement requires that the enforcers have more power than those who are constrained by institutions. This raises the problem of how those who have enforcement power can have sufficient power to produce an orederly and productive society, but can be constrained to prevent them from abusing their power. Three broad alternatives are considered: democratic oversight, constitutional rules, and checks and balances. All three have a role to play, but constraints on the abuse of power will be ineffective without a strong system of checks and balances.

제도는 사회에서 개인들 간의 ‘질서 있는 사회적 상호작용’을 하는 데 필요하다. 질서를 확립하기 위해서는 ‘제도적 제약’이 시행되어야 하고, 이의 시행을 위해서 시행 자들은 제도에 의해 제약을 받는 일반 사람들보다 더 많은 권력을 가져야만 할 것이다. 시행 권력을 가진 사람들이 질서 있고 생산적인 사회를 만들기에 충분한 권력을 가질 수 있지만, 그들이 자신의 권력을 남용하는 것을 방지하기 위해 권력을 어떻게 제한하 느냐가 중요한 문제로 제기된다. 이를 위해 ‘민주적 감독, 헌법 규칙, 견제와 균형’이라 는 세 가지 광범위한 대안이 고려될 수 있다. 세 가지 대안 모두 각자의 역할이 있지만, 특히 ‘강력한 견제와 균형 시스템’ 없이는 권력 남용에 대한 제약은 결코 효과적이지 않을 것이다.
