Purpose : Considering that Korea will be transporting international rail freight to Europe in the future, research will be needed on the international rail freight agreement applied by Eurasia. As an initial research stage, this study conducted an exploratory study on the obligations and rights of transport parties under the International Rail Freight Transport Agreement (SMGS) observed in Asia and Russia. Research design, data, methodology : In this study, as there is still a lack of introduction to the International Rail Freight Transport Agreement (SMGS) in Korea, an exploratory study was conducted focusing on the obligations and rights of transportation parties stipulated in this agreement (SMGS). Results : In order to apply the International Rail Cargo Agreement (SMGS), the requirements of 'Internationality and whether or not it is a Contracting State of the International Rail Cargo Agreement' must be satisfied. In particular, this agreement stipulates that it applies to rail transport between the countries to which the agreement is subscribed, and the relevant transport contract provisions that directly or indirectly violate this agreement are invalid and have no legal effect. Conclusions : In this study, a study was conducted on the obligations and rights of the transporting parties in the International Rail Freight Transport Agreement complied with in Asia and Russia.

유라시아 국제철도기구는 각 국가의 국제철도운송 규정을 통일화하기 위하여 국제철도화물운 송협정을 제정하였으며 대부분의 유럽·아시아 국가에서 준용하고 있다. 국제철도운송은 2개국 이상의 국가영토를 경유하는 특징이 있어 국제철도운송 사고발생시 각 국가의 분쟁으로 발생될 수 있다. 이를 대비하여 국제철도협력기구(OSJD)에서는 국제철도화 물운송 중 운송사고 발생 시 운송당사자(운송인, 송하인, 수하인)의 의무 및 면책의 판단 기준 이 되는 국제철도화물운송협정(SMGS)을 제정하였다. 최근 한반도에서 유럽까지 연결되는 국제철도운송이 논의됨에 따라 국제철도화물운송협정에 관한 연구가 필요할 것이다. 본 연구에서는 아시아･러시아에서 준수하고 있는 국제철도화물운 송협정의 운송당사자 의무 및 권리에 관한 탐색 연구를 실시하였다. 그 연구 결과 본 협정에서는 운송인. 송하인. 수하인의 의무 및 권리를 규정하고 있는데 협약 규정을 직간접적으로 위반하는 경우 무효이며 법적효력이 없다고 규정하고 있는 만큼 의무 및 권리에 대한 규정은 필수적으로 충족되어야 할 것으로 판단된다.
