The government's interest in and efforts to solve the elder abuse problem is relatively insufficient compared to the child and women abuse problem. Among these, the most pressing issue in dealing with elder abuse is that there is no specialized legislation on elder abuse. In both domestic violence and child abuse, special laws were enacted to sanction perpetrators, protect and support victims, and various procedures are in place to intervene promptly. However, the current law to which elder abuse is applied is composed only of regulation and punishment in the legislative system, and it is not concrete and subdivided in legislative technology, so it is not able to effectively deal with elder abuse. In this regard, the concept of elder abuse, types of punishment for elder abuse, proof of elder abuse and elder abuse were established by establishing special cases for the punishment of elder abuse crimes such as more effective investigation of elder abuse, protection of the elderly victims, and strengthening punishment of elder abusers. Various matters should be procedurally prepared, ranging from the criminal case handling procedure, sanctions against elder abusers, and the order system for protecting elder abuse victims. Therefore, after examining whether this law is effective, focusing on the provisions on elder abuse under the Elderly Welfare Act, we intend to prepare problems and countermeasures for elder abuse crimes.

노인학대 문제해결에 대한 국가의 관심 및 노력이 상대적으로 아동과 여성학 대 문제에 비해 상대적으로 매우 부족하여 노인학대의 예방과 대책을 노인복지 법상에 규정하고 있음에도 불구하고 노인학대 대책은 사실상 부족하다. 이러한 가운데 노인학대 사안 처리에 가장 시급한 것이 노인학대에 전문화된 입법이 없 다는 점이다. 가정폭력과 아동학대 모두 특례법 제정을 통해 행위자에 대한 제재 와 피해자 보호 및 지원 노력을 하고 있고, 신속한 사건개입을 위한 다양한 절차 를 마련해두고 있다. 하지만 노인학대가 적용되는 현행 법률은 입법 체계적으로 는 규제 및 처벌 위주로만 구성되어 있고, 입법기술적으로도 구체화 · 세분화 되어 있지 못하여 노인학대에 대해 실효성있게 대처하지 못하고 있다. 이에 좀더 실효성 있는 노인학대의 조사, 피해노인의 보호, 노인학대자의 처벌 강화 등 노 인학대범죄의 처벌 등에 관한 특례를 정함으로써 노인학대행위의 개념부터 노인 학대행위 처벌유형, 노인학대행위 입증과 노인학대범죄의 사안처리절차, 노인학 대행위자에 대한 제재, 노인학대피해자 보호를 위한 명령제도에 이르기까지 다양 한 사항이 절차적으로 구비되어야 할 것이다. 따라서 노인복지법상 노인학대에 관한 규정을 중심으로 이 법률이 실효성이 있는지를 검토한 후 노인학대범죄에 대한 문제점과 대응방안을 마련하고자 한다.
