The neutralization theory continuously pointed out the simplified logic of learning theory based on the concept of drift, but the neutralization theory was somewhat neglected while learning theory explained a number of crimes like general theory. Of course, the action of neutralization is essentially abstract, so it is impossible to determine the temporal precedence with crime, but it was judged to be meaningful in some crimes that are apt for denying the damage. Therefore, this study was primarily conducted to confirm the validity of the neutralization theory as an explanatory theory of illegal gambling and further attempt to expand to the entire victimless crimes. To this end, perception of gambling neutralization and illegal gambling behavior were regarded as causes and effect relationship, and multiple regression analysis was conducted. As a result of the analysis, it was found that the perception of gambling neutralization enhances illegal gambling behavior. The neutralization mechanism, expressed as justification or rationalization, has emerged as a direct cause of illegal gambling behavior. Based on the results of this analysis, the significance of the theory explaining the victimless crimes and review of public advertisement of legal gambling business were discussed.

중화이론은 표류라는 개념을 바탕으로 학습론의 단순한 방향성을 지속적으로 지적하였으 나, 학습론이 마치 일반이론처럼 다수의 범죄를 설명하는 동안 중화이론은 다소간 경시되었 다. 물론 중화라는 작용이 본질적으로 추상적이기에 범죄와의 시간적 선후를 확정적으로 재단 할 수는 없지만, 피해 사실을 부인하기 유리한 일부 범죄에서는 유의미할 것으로 판단되었다. 이에 이 연구는 일차적으로 불법사행행위의 설명이론으로서 중화이론의 타당도를 확인하 고 나아가 피해자 없는 범죄 전반으로의 확장을 시도하고자 수행되었다. 이를 위하여 사행행 위 중화인식과 불법사행행위를 확률적 인과로 간주하고 다중회기분석을 실시하였다. 분석 결 과 사행행위 중화인식은 불법사행행위를 제고하는 것으로 나타났다. 정당화 혹은 합리화로 표현되는 중화기제가 불법사행행위의 직접적인 원인으로 등장한 것이다. 이러한 분석 결과를 바탕으로 사행행위 대민홍보의 재검토와 피해자 없는 범죄의 설명이론으로서 중화이론의 의 의를 논하였다.
