In this paper, we analyzed the Japanese autonomous police system, which is judged to be operating the most similar type of police system to Korea under the above concerns, and considered the proper establishment of the current autonomous police system. As a result of the study, the following conclusions could be drawn. First, it is necessary to establish an indirect relationship between the National Police Agency, the Autonomous Police Committee, and the autonomous police to recognize mutual independence and prevent specific command and supervision. Second, it is necessary to operate a "local superintendent of police system" in which the self-governing police appoint and dismiss more than a correctional class as the national police in order to strengthen cooperation with the national police and maintain the current security stability effect of the national police. Third, it is necessary to improve the negative perception and ability of the autonomous police by revitalizing personnel exchanges between the national police and the autonomous police. Fourth, the unit of police law enforcement activities should be unified into autonomous police to prevent redundancy in autonomous police affairs and to perform tasks responsibly by conducting independent police activities. Fifth, the self-governing police committee must accurately understand the authority prescribed by law and set the scope of its role in detail so that the self-governing police committee must perform practical authority.

본고에서는 위와 같은 고민 아래 우리나라와 가장 유사한 형태의 경찰 제도를 운영하고 있다고 판단되는 일본의 자치경찰제를 분석하여 현재의 자치경찰제도의 올바른 정착에 대해서 고찰해보았다. 연구결과, 다음과 같은 결론을 도출해낼 수 있었다. 첫째, 경찰청․자치경찰위원 회와 자치경찰을 간접적인 관계로 설정하여 상호 간의 독립성을 인정하고 구체적 인 지휘․감독을 방지해야 한다. 둘째, 자치경찰의 국가경찰에 대한 협력 강화와 현 재 국가경찰의 치안안정 효과 유지를 위해서 경정(警正) 이상의 계급을 국가경찰 로 임면하는 ‘지방경정 제도’를 운영할 필요가 있다. 셋째, 국가경찰과 자치경찰의 상호 간 인사교류 활성화를 통해서 자치경찰의 부정적인 인식 개선 및 능력 향상 을 도모해야 한다. 넷째, 경찰 법집행 활동의 단위를 자치경찰로 일원화하여 자치 경찰사무의 중복성을 막고, 독립적인 경찰활동을 함으로써 책임감 있게 업무수행 을 하도록 해야 한다. 다섯째, 자치경찰위원회가 법률상 규정된 권한을 정확히 이 해하고 그 역할의 범위를 구체적으로 설정하여 자치경찰위원회가 실질적인 권한 을 수행해야만 한다.

    본 학회는 자치경찰이 시행되어야 하는 당위성을 자치경찰이 시민 가까이에서 범죄예방 활동을 하고 교통질서를 유지하면서 시민의 생명과 재산을 직접지켜야 한다는 자치경찰 본래의 목적을 달성하는데 조금이나마 학문적으로 기여하고자 설립되게 됐다. 본 학회는 특히 자치경찰 이념에 입각하여 유럽의 자치경찰 사례를 바탕으로 향후 우리나라 전역의 기초자치단체에서 시행되게 될 자치경찰제를 자치경찰조직, 자치경찰인사, 자치경찰재무측면에서 집중연구하기 위해 설립되었음을 밝혀둔다. 또한 자치분권제도에 관해서도 집중 연구함을 목적으로 한다.
