A series of recent child abuse cases are causing social resentment. The occurrence of such child abuse still reflects a very passive reality in preparing active countermeasures while recognizing the seriousness of child abuse. Children, unlike adults, often fail to respond to exposure to violence, and the social system network that protects them is still insufficient. The Convention on the Rights of the Child, which Korea joined in 1991, has served as a guideline for guaranteeing children’s rights. Since then, efforts have been made to prepare, maintain, and improve the legal system for children’s human rights in Korea, which has served as a factor that brings about changes in children’s human rights in Korea, which is still valid. However, despite the efforts so far, the quality of life of Korean children, which is confirmed through international indicators and various surveys, is at the lowest level. Accordingly, in order to realize the human rights of children in school age, it is necessary to guarantee the human rights of children, which are insufficient legally and institutionally, and to make efforts to improve them. The four so-called rights to children stipulated by the UN Convention on the Rights of the Child are human rights that should be guaranteed by our legislation, and the non-fulfillment regulations recommended by the UN Committee on the Rights of the Child should be recognized and implemented. Human rights issues related to children are universal human rights that must be guaranteed equally domestically and internationally. It is necessary to ensure that human dignity is guaranteed in the child’s position through legal maintenance and institutional improvement efforts in areas that are still insufficient and concerned about child human rights. In addition, as a practical task for this, appropriate child rights education should be provided to the government, including parents and teachers who are child care givers.

최근 발생한 일련의 아동학대 사건은 사회적으로 공분을 사고 있다. 이러한 아동학대의 발생은 여 전히 아동학대에 대한 심각성은 인식하면서도 이에 대한 적극적인 대응책을 마련하는 데는 매우 소극 적인 현실을 반영하는 일면을 보여주고 있는 것이다. 아동은 성인과 달리 폭력에 대한 노출에 대응하 지 못하는 경우가 대부분이고 이들을 보호해주는 사회적 제도망도 여전히 미흡한 상황이다. 1991년 우리나라가 가입한 아동권리협약은 아동인권 보장의 가이드라인 역할을 해왔다. 이후 국내 에서는 아동인권에 대한 법제도 마련과 정비 및 개선을 위한 노력이 있어왔고 이는 국내 아동인권에 대한 변화를 가져오게 하는 요인으로 작용하였으며, 이는 여전히 유효하다. 하지만 그동안의 노력에도 불구하고 국제지표와 다양한 조사를 통해 확인되는 우리나라 아동의 삶의 질은 최저 수준으로 나타나 고 있다. 이에 학령기 아동인권의 실현을 위하여 법제도적으로 미흡한 아동인권 보장과 그 신장 노력 이 필요하다. 유엔 아동권리협약이 규정하고 있는 아동에 대한 소위 4대 권리는 우리 법제에서도 보장되어야 할 인권이며, 유엔 아동권리위원회가 그동안 권고해온 규정은 아동인권을 높이기 위해 개선이 필요한 과 제임을 인식하고 그 이행 실천이 이루어져야 할 것이다. 아동에 관한 인권문제는 보편적 인권으로서 국내외적으로 동등하게 보장되어야 하는 권리이다. 아 동인권에 대해 여전히 미흡한 부분의 법적 정비와 제도적 개선을 통해 아동의 지위에서 인간의 존엄성 을 보장받도록 하여야 한다. 또한 이를 위한 현실적 실천 과제로 아동의 양육자인 부모, 교사 등을 포 함한 정부에 대한 적절한 아동인권교육이 이루어져야 할 것이다.
