Based on the analysis of the current “ACT ON PREVENTION OF ACCIDENTS AT COASTAL SEA” revised in April 2021, this study reviews the overall problems that need to be improved for effective coastal accident prevention, and among them, This was done for the purpose of deriving an alternative. In order to achieve the purpose of the study, an analysis was conducted in terms of roles and authority of related institutions, other organizations and organizations, operating systems and regulations targeting the current ｢ACT ON PREVENTION OF ACCIDENTS AT COASTAL SEA｣ and its enforcement ordinances and enforcement rules. As a result of the research, establishment of the authority and role of related organizations for the prevention of coastal accidents, the specification of roles and functions of the regional coastal accident prevention council, the realization of qualification requirements for coastal patrols, obligatory support for expenses by the heads of local governments to secure the effectiveness of the coastal safety guard system, It was proposed to reorganize the penalty rules suitable for the principle of the principle of the criminal justice system, and to newly establish the rules for the fines for negligence targeting offenders. Although the study has limitations in that it could not even suggest specific and individual revisions, this study differs from previous studies in that it discovers problems that could not be raised in previous studies and suggests alternatives.

이 연구는 지난 2021년 4월 개정된 현행 ｢연안사고예방법｣에 관한 분석을 토대로 효과적인 연안사고 예방을 위해 개선되어야 할 전반적 문제점들에 대해 다시 검토하 고 이 중 우선적으로 검토되어야 할 문제들에 대한 대안을 도출함을 목적으로 수행 되었다. 연구목적 달성을 위해 현행 ｢연안사고예방법｣ 및 시행령, 시행규칙을 대상으 로 관련기관의 역할 및 권한, 기타 기구 및 조직, 운영제도 및 규제의 측면에서 분석 을 실시하였다. 연구결과 연안사고 예방을 위한 관련기관의 권한 및 역할정립, 지역연안사고예방 협의회의 역할 및 기능 구체화, 연안순찰대의 자격요건 현실화, 연안안전지킴이 제도 의 실효성 확보를 위한 지방자치단체장의 경비 지원 의무화, 죄형법정주의의 원칙에 적합한 벌칙규정의 정비, 행위자를 대상으로 하는 과태료 규정 신설 등을 제안하였다. 구체적·개별적 개정안까지 제시하지는 못하였다는 점에서 연구의 한계가 존재하나, 기존 선행연구에서 제기하지 못했던 문제들을 발견, 대안을 제시하였다는 점에서 이 연구는 선행연구와의 차별성을 가지며 그 의의가 있다고 하겠다.
