Jeong Yak-yong suggested his own theory of four-seven based on the existing four-seven discussion, by commenting on it. This study examines how Jeong's theory of four-seven and his theory of human nature as moral inclination can be applied in practice. The former is an extension of Seongho School's theory of seven public feelings and the latter is discussion on the cognitive judgment of moral emotions. Subsequently, the paper looks into cases in which the court gave reduced punishment based on moral emotions and discusses Jeong's view on tension between moral emotions and law. It moves on to analyzing the precedents about which Jeong stated that the law should be bending when judging and discussing what his theory of emotions practically implies. The findings provide the basis in seeking the interface between Jeong's philosophy and theories of emotions discussed in the contemporary philosophy.

정약용은 기존의 사칠논변(四七論辨)에 대한 그의 견해를 밝혀 간접적으로 자신의 사칠설(四七說)을 드러냈다. 본 연구는 그러한 정약용의 사칠설이 그의 성기호설(性嗜好說)과 함께 어떻게 실천적 영역에 적용될 수 있는지 고찰한다. 그 과정에서 정약용의 사칠설은 성호학파(星湖學派)의 공칠정(公七情) 논변의 연장선상에 있으며, 그의 성기호설은 도덕 감정의 인지적 판단에 관한 논의임을 검토한다. 이어서 정리(情理)를 적용하여 처벌을 감면한 판결에 대한 정약용의 견해를 살펴 그가 제시한 감정과 법의 긴장 문제를 논한다. 특히 정약용이 법을 굽혀[屈法] 판결해야 한다고 말한 판례를 분석하고, 그의 감정설이 실천의 측면에서 어떤 의미를 지니는지 확인한다. 그로부터 정약용의 철학과 현대적 감정이론의 접점을 모색한다.
