In December 2018, the CEPEJ adopted the first European Ethical Charter on the use of artificial intelligence in judicial systems. This innovative text, prepared by the CEPEJ Working Group on quality of justice (CEPEJ-GT-QUAL), sets out principles to guide the development of artificial intelligence tools in European judicial systems. In other words, The use of artificial intelligence was recommended to improve and visualize precedent search systems, to improve judicial access, and to create new strategic trial aids. Although this is an area that requires considerable methodological attention, artificial intelligence is considered as an area where artificial intelligence can be used for statistical analysis of similar civil judgments, as well as for assisting in alternative dispute resolution procedures(ADR) in civil procedures or online dispute resolution procedures(ODR). This is the time when artificial intelligence is expected to be introduced in a significant part of the civil procedure area of the Common law system, including the United States. The Supreme Court also introduced “AI.NER,” an information analysis and security artificial intelligence data solution that combines data analysis and artificial intelligence, into the Supreme Court ruling search system. Especially, The Language Intelligence Research Team of the Electronics and Telecommunications Research Institute is conducting the 'Exobrain Project', which aims to develop artificial intelligence software that can answer questions with experts(Example: Attorney, Patent Attorney). It aims to develop a “professional decision-making support system” that can be used in the legal, patent, financial, and public fields. This thesis examines the development and application prospects of legaltech using artificial intelligence(AI) in the criminal justice system, and examines the possibility of application in sexual crimes in particular.

2018년 말 ‘유럽평의회 사법 효율을 위한 유럽위원회’(CEPEJ)는 ‘사법 시스템에서 AI 사용에 관한 유럽 헌장’을 채택하면서, 사법 효율을 위해 인공지능의 활용을 권고하였다. 즉, 선 판례 검색 시스템을 개선 및 시각화하거나 사법 접근권을 향상하기 위해, 그리고 새로운 전략적 재판 보조 도구를 창출하기 위해 인공지능의 활용을 권장하였다. 나아가 서로 유사한 민사 분쟁 결과들에 대한 통계적 분석을 위해 인공지능을 활용하는 경우와 민사절차법상 대체적 분쟁 해결 절차(ADR)를 보조하기거나 온라인 분쟁 해결 절차(ODR)의 경우에 대해서도 상당한 방법론적 주의가 필요한 영역이기는 하지만 인공지능이 활용 가능한 영역으로 보고 있다. 미국을 비롯한 영미법 체계의 민사절차상 영역에 상당 부분 인공지능의 도입이 예상되는 시점이라고 할 수 있다. 우리나라 대법원도 데이터 분석과 인공지능을 결합한 정보 분석 및 보안 인공지능 데이터 솔루션 인 “에이너(AI.NER)”를 대법원판결 공개시스템에 도입하였다. 특히, 한국전자통신연구원의 언어지 능연구팀은 전문가(예: 변호사, 변리사)와 질의응답이 가능한 인공지능 SW 개발을 목표로 하는 엑소브레인 프로젝트를 진행하고 있으며, 이는 법률, 특허, 금융, 공공분야 등에서 활용 가능한 “전문분야 의사결정 지원 시스템”의 개발을 목표로 하고 있다. 본 논문에서는 형사사법 제도에 있어서 인공지능(AI)을 활용한 리걸테크의 발전과 활용 전망에 대해 알아보고, 특히 성범죄에서의 활용 가능성에 대해 검토해 보기로 한다.
