The purpose of this study is to discuss the introduction and operation of Korean drug courts by analyzing factors associated with successful drug court in the United States. Through this, this study aims to prevent recidivism of drug-addicted offenders, to assist their community rehabilitation, and to propose an alternative form of problem-solving court in the current criminal justice system in Korea. This study divided the factors of the US drug court into three categories (court operation, supportive service, and therapeutic service) using the US problem-solving courts census data, and analyzed the effect of these factors on the success of the drug court program. As a result, the larger the total number of participants, the larger the number of regular employees, the more frequent the drug court sessions, and the longer the drug court history, the more successful the program was. In addition, in relation to therapeutic service, drug courts that provide addiction treatment (both less than 90 days and longer than 90 days) had more successful completion of the program participants. Korean society, where the drug addiction problem is getting serious, should consider the establishment of a drug court that can solve the problem and prevent recidivism by alternating the current criminal justice system centered on punishment for crimes.

본 연구의 목적은 미국 약물법원의 성공적인 운영에 영향을 미치는 요인들을 분석함으로 써 한국적 약물법원 도입 및 운영에 대해서 논하는 것이다. 이를 통해 약물중독 범죄자의 재 범을 막고, 재활을 도우며, 무엇보다 처벌위주의 현행 한국 형사사법체계에 대한 대안으로 문제해결법원을 제시하고자 한다. 본 연구는 미국 문제해결법원 센서스자료를 활용하여 미국 약물법원의 요인들을 세 가지 범주(법원운영, 지지적 서비스, 치료적 서비스)로 나누고, 이 요인들이 약물법원 프로그램의 성공에 미치는 영향을 분석하였다. 분석결과 전체참여자 수가 많을수록, 정규직 직원의 수가 많을수록, 약물법원 운영역사가 길수록, 약물법원이 기일을 자주 갖을수록, 성공적으로 프로그램을 이수한 참여자가 많았다. 또한, 치료적 서비스와 관 련하여 중독치료(90일 이하 및 이상 모두)를 제공하는 약물법원일수록 성공적으로 프로그램 을 이수한 사람이 많았다. 이러한 연구결과에 기반하여 볼 때, 약물중독 범죄의 문제가 날로 심각해지는 한국사회는 범죄에 대한 처벌중심의 현행 형사사법체계를 벗어나서 문제를 해결 하고 재범을 방지할 수 있는 약물법원의 도입을 적극적으로 검토해야 할 것이다.
