In enacting a law, the legislator must act consistently. It must adhere to the principles set by itself. If it deviates from the principles established by itself without reasonable ground, the law will be estimated as having illicit motives. Thus, the constitutional meaning of the legislator’s self-determination and the aspects in which they are considered in judicial review are controversial. In the German federal constitutional court, the consistency review, which was originally used to demonstrate the principle of equality in the area of tax law, has been extended to the laws witch restrict liberty rights and guarantee social rights. Consistency review means leaving the responsibility of concretizing the constitution to the legislator and demanding justification for any deviation from the principles set by itself. The consistency review can serve to control the legislator in areas where judicial review of substantive content is difficult while respecting the legislative margin of appreciation.

입법권을 행사함에 있어서 입법자는 일관되게 행동해야 한다. 입법자 는 스스로 결정한 원칙을 준수하여야 하고, 스스로 정립한 원칙으로부터 합리적 근거없는 이탈은 부당한 동기를 추정케 하는 효과를 갖는다. 관 련하여 입법자의 자기구속이 갖는 헌법적 의미와 한계, 그리고 그것이 사법심사에서 고려되는 국면이 문제된다. 당초 조세법 영역에서 평등권 심사에 활용되었던 일관성심사는 연방헌법재판소 헌법실무에서 점차 자 유권과 급부권 영역으로까지 확대되었다. 일관성심사는 헌법을 구체화하 는 책임을 일차적으로 입법자에게 맡겨두고 입법자 스스로 설정한 원칙 에서 벗어날 경우 그에 합당한 정당화를 입법자에게 요구하는 것을 뜻한다. 우리 헌법실무에서 이 심사가 활용될 경우 입법자의 입법형성권을 존중하면서도 실체적 내용에 대한 사법심사가 곤란한 영역에서 입법권을 효과적으로 통제하는 기능을 수행할 수 있다.
