19) Due to the chractertics of maritime crimes, the proportion of special laws related to maritime and fisheries is about 85% in the field of the sea area, and the arrest rate is very high compared to crimes on land because they are arrested immediately after the crime occurs. In addition, due to the special environment of the ocean, such as the spatial isolation, the possibility of evidence contamination, and the scarcity of case, crimes’ evidence of maritime and fisheries are likely to disappear if they fail to catch criminals at the scene. Therefore, rapid arrest and initial investigation of the criminal at the scene. is one of most important element. In other words, Investigation officers should equipped maritime minds and expertise in operating ships as well as general investigative techniques and procedures so that it errors in the investigation process is minimized Meanwhile, the korea coast guard have made huge changes in the judicial system since redesign of national system of investigations The coast guard investigation service were commanded by the prosecution during the investigation process, but from this year, the coast guard investigation service was given the authority to investigate, so it is necessary to enhance the responsibility and fairness. In addition, by amending the coat guard Act, the Commissioner general of the Korea Coast Guard specifically prohibits the investigation, command and supervision of individual cases to secure the independence of the investigation, The investigation commanding scheme has been reorganized so investigation of individual case should be directed and supervised by the head of the investigation department (director of the investigation department) This study compares and analyzes the characteristics of maritime crimes and the investigation service of the coast guard according to the redesign of investigation system with the National Police Agency, A direction for improvement was suggested to develop the investigation function of the coast guard

해양범죄 특성상 해양에서 해양수산 관련 특별법의 비중이 85%정도 발생하고 있 으며 범죄발생 즉시 검거되어 육상범죄보다 검거율이 매우 높다. 또한 해양이라는 특수성으로 육상범죄와 달리 고립성과 이격성, 증거의 오염가능성, 사건의 희소성 등 으로 해양범죄는 현장에서 범인을 검거하지 못할 경우 증거가 유실될 가능성도 있어 서 범인의 신속한 검거와 초동수사가 매우 중요하다. 즉, 수사경찰의 수사기법은 일 반적인 수사기법과 절차의 전문지식도 중요하지만, 해양이라는 마인드를 함양하고 선박 운용술의 전문성도 있어야 수사과정에서 오류를 최소화 할 수 있다. 한편, 수사권 조정 이후 올해 해양경찰청에서는 사법환경에 많은 변화를 맞이 하 고 있다. 검사의 지휘를 받던 과거와는 달리 경찰에게 1차 수사종결권이 부여되어 권한이 커진 만큼 수사의 책임성과 공정성, 완결성을 요구하고 있다. 이와 더불어 ｢해 양경찰법｣을 개정하여 해양경찰청장이 개별사건에 대한 구체적으로 수사·지휘감독을 금지하여 수사의 독립성을 확보하고, 수사사무는 수사부서장(수사국장)이 지휘·감독 하도록 하는 등의 수사기능을 개편하였다. 본 연구에서는 해양범죄의 특성과 수사권 조정에 따른 해양경찰 수사기능을 경찰 청과 비교 분석하고, 해양경찰 수사 원년의 해인 만큼 수사기능을 더욱 더 발전시키 기 위한 개선방향을 제시하였다.
