The purpose of this paper make legislative suggestions for the enactment of church laws by discovering the proper relationship between universal and particular church in the Reformed and Presbyterian church and revealing their homogeneity and differentiation. To this end, it first defined the universal and particular church, and revealed their homogeneity and differentiation from the biblical and Reformed Theological perspectives, perspectives of church law and national legal perspectives. From the perspective of reformed theology, I confirmed that the universal and particular church should be united in the Holy Spirit, while rejecting hierarchical order thoroughly. First, the constitution of denomination and the laws of the Church must be enacted and amended to match the confession of faith and historical church law. Second, institutional and legal mechanisms should be in place to prevent the abuse of authority of the General Assembly of the Church. Third, It is shall be clarified the legal nature of the ‘The Directory for Worship’ and ‘Service Book’ of worship under the constitution of the denomination implemented by the Presbyterian Church. Finally, the church bylaw should include the historical confession of faith and the tradition of church law, as well as the establishment of a “Committee to deliberate on constitution and church bylaw” to help local churches to prevent conflicts between national and church laws.

본 논문의 목적은 개혁교회 및 장로교회에서 보편교회와 지교회의 적절한 관계를 발견하고 그 동질성과 차별성을 드러내어 교회법 제정 을 위한 입법론적 제언을 하기 위함이다. 이를 위하여 먼저 보편교회와 지교회를 정의하고, 성경과 개혁신학적 관점 및 교회법적 관점 그리고 국가법적 관점에서 그 동질성과 차별성의 의미를 밝혔다. 필자는 개혁 신학의 입장에서 보편교회와 지교회가 위계적인 질서를 거부하면서도 성령 안에서 하나 됨을 이루기 위하여‘체계정당성의 원리’을 충분히 고려하여 교회법 법제화에 다음과 같은 점을 제언하였다. 첫째, 교단의 헌법과 교회법들은 신앙고백서와 역사적 교회법과 일치되도록 제 · 개정되어야 한다. 둘째, 교단 총회의 교권주의화를 방지하는 제도적 법 적 장치가 마련되어야 한다. 셋째, 장로교회에서 시행하고 있는 교단 헌법상의‘예배모범’과‘예배서’의 법적 성격을 명확히 하여야 한다. 마지막으로 지교회의 교회정관은 상기 역사적 신앙고백과 교회법의 전 통은 물론 국가법과 교회법이 충돌하지 않도록「정관제·개정 심의위 원회」를 두어 지교회를 도와야 함 등이다.
