With the recent remarkable development in life science, our lives have become richer. The evolution of medicine in the field of bioscience leads to rapidly increasing the quality of life in old age including life extension. Behind these circumstances is the sacrifice of experimental animals. In a situation where there are insufficient methods enough to replace the animal testing, the voice of animal protection and welfare is growing. To this end, America was already enacted the Animal Welfare Act in the 1960s and has been endeavored to minimize the unethical sacrifice, which may happen in the experimental process, along with the proper management of experimental animals. The Animal Welfare Act prescribed in detail as for the guidance and supervision of the animal testing facilities in order to realize this specifically as well as the abstract contents relevant to animal protection. Through directly regulating the investigation and supervision of the experimental animals, America is emphasizing the legal and moral obligation of researchers who use experimental animals in addition to managing the experimental animals in the national dimension. This study examines about the background & contents of enacting the Animal Welfare Act in America and about the procedure of guidance & supervision on the facilities of using experimental animals. In the United States, the implementing agency of the Animal Welfare Act is the Federal Department of Agriculture. The Federal Department of Agriculture is suggesting the detailed guideline regarding the investigation & supervision on the animal testing facilities. Based on this, the aim is to bring forward even the implication for our country’s legislation to protect laboratory animals.

최근 생명과학의 발전이 두드러지면서 우리의 삶은 보다 풍성해졌다. 생명과학 분야 중 의학의 발전은 생명의 연장과 더불어 노년기의 삶의 질을 비약적으 로 상승시키고 있다. 이러한 상황의 이면에는 실험동물의 희생이 있다. 동물실험 을 대체할만한 실험방법이 미비한 상황에서 동물보호와 복지의 목소리가 커지고 있다. 이를 위하여 미국에서는 이미 1960년대부터 동물복지법을 제정하여, 실험 동물에 대한 적정한 관리와 실험과정에 발생할 수 있는 비윤리적인 희생을 최소 화하기 위한 노력을 해왔다. 동물복지법은 동물보호에 관련된 추상적 내용뿐만 아니라 이를 구체적으로 실현하기 위하여 동물실험시설에 대한 지도·감독에 관 하여 상세하게 규정하였다. 미국은 실험동물 시설의 조사·감독과 같은 직접적 규 제를 통하여 실험동물에 대한 국가 차원의 관리와 실험동물을 이용하는 연구자 에 대한 법적, 도덕적 의무를 강조하고 있다. 본 논문에서는 미국의 동물복지법 의 제정 배경와 내용, 실험동물을 이용하는 시설에 대한 지도·감독의 절차에 대 하여 검토한다. 미국은 동물복지법의 시행기관은 연방농림부이며, 연방농림부는 동물실험 시설에 대한 조사·감독에 관한 세부적인 가이드 라인을 제시하고 있다. 이를 바탕으로 우리나라의 실험동물 보호를 위한 법제에 주는 시사점도 제기하 고자 한다. 인간의 생명연장과 생활 질적 향상을 위하여 동물실험은 필수적이라 는 인식이 있지만, 동물이 겪는 고통을 줄이기 위한 노력은 진행형이다. 동물실 험을 대체할만한 대안실험 개발이 미비한 현 시점에서 동물실험에 대한 감독·관 리를 위한 제도적 보안과 입법적 대안에 대하여 검토하고자 한다.
