The Direct democracy plays a role in raising the national will empirically confirmed to the constitutional principle in the reality of the crisis of representative democracy. However, there is always a possibility that national sovereignty will be imbalanced because there is no choice but to indirectly control the people by representative democracy. This study focused on the reinterpretation of the tendency to criticize direct democracy itself, arguing that direct democracy is more likely to be manipulated by political elites and that representative democracy led by elites is more universally preferred. It also criticized that representative democracy raised questions about the limitations of deliberative democracy and the decision-making power of majority voting, and summarized the discussion on reinterpretation. In conclusion, I proposed rational criticism and reinterpretation of how direct democracy, as a revision or supplement of representative democracy, could maintain the basic framework of representative democracy and increase participation and control by the people in the modern crisis of the representative system.

직접민주주의는 대의민주주의의 위기 속에서 경험적으로 확정된 국민의사를 헌법적 원 리로 끌어올리는 역할을 수행한다. 다만, 대의민주주의에 의한 국민의 통제는 간접적으로 할 수 밖에 없어 국민주권주의가 형해화(形骸化)될 가능성이 존재하며 이를 수정 보완하기 위한 논의가 지속적으로 필요하다. 본 연구는 직접민주주의가 정치 엘리트에 의해 조작되기 쉬우며 정치 엘리트가 이끄는 대의민주주의를 보편적으로 더 선호하는 것이라고 주장하며 국가 및 사회의 구성원에게 두루 관계되는 공공(public)과 안전(Safety)이라는 개념을 지나치게 강조하여 직접민주주의 자체를 비판하는 경향에 대한 재해석에 주목하였다. 또한 대의민주주의가 심의민주주의의 한계점과 다수결에 의한 의사결정 자체에 의문을 제기하는 것을 비판하며 이에 대한 재해 석 논의를 정리하였다. 연구 결과, ‘엘리트에 의한 지배 현상, 심의민주주의의 한계, 다수결의 위험성’ 등의 문제 가 공공과 안전 개념을 강조하며 직접민주주의를 일률적으로 비판하는 것을 발견할 수 있 었다. 그러므로 정치적 이데올로기의 통합과 공공성을 동시에 확보하기 위하여 직접민주주 의가 대의민주주의의 기본적인 틀을 유지하면서 대의민주주의의 수정 혹은 보완 수단으로 서 국민 전체의 공공과 안전을 유지하며 참여와 통제를 어떻게 신장시킬 수 있을 것인가에 대한 합리적 비판과 재해석을 제안하였다.
