The purpose of this study is to contribute to the efficient promotion of public works and to faithfully protect the people's property rights and living rights by deriving the issues of living measure system of public works in Korea and seeking the improvements based on this. To this purpose, the jurisprudential approach was first attempted to interpret the legal principles of living measure of public works. Next, the implementation case analysis, dispute case analysis, and precedent analysis were conducted to analyze the actual condition of living measure of public works. After deriving the issues of living measure system of public works by combining the legal principles interpretation and actual condition analysis, the improvements were sought based on this. From the perspective of realizing justified compensation in relation to the living measure system of public works, the following improvements were devised as the result of deriving legal and institutional issues focusing on the equity aspect of living measure and the smoothness aspect of public works, and seeking the improvements. First, in order to secure the equity of contents of living measure, the basic regulations for establishment and implementation of living measure should be newly established in the ｢Act on the Acquisition and Compensation of Land for Public Works, etc.｣. Second, in order to secure the equity of living measure targets, the scope of living measure targets should not be limited to those who have entered into the consultation contracts and migrated by themselves, but also include those who have been judged the expropriation decision. Lastly, in order to support the migrants to smoothly convert to the other vocations, the professional vocational training should be preceded by the preferential hiring and job placement.

본 연구는 공익사업 생활대책제도의 문제점을 도출한 후 이를 토대로 하여 개선방안을 모색함으로써 국민의 재산권 및 생활권을 충실히 보호하고 공익사업을 효율적으로 추진하 는 데에 기여함에 목적이 있다. 이를 위하여 우선적으로 공익사업 생활대책의 법리를 해석 하기 위하여 법이론적 접근을 시도하였고, 다음으로 공익사업 생활대책의 실태를 분석하 기 위하여 실시사례분석, 분쟁사례분석, 판례분석 등을 실시하였으며, 마지막으로 법리해 석과 실태분석을 종합하여 공익사업 생활대책제도의 문제점을 도출한 후 이를 토대로 하 여 개선방안을 모색하였다. 공익사업의 생활대책에 관하여 정당보상의 실현의 관점에서 생활대책의 형평성 측면과 공익사업의 원활성 측면을 중심으로 법제도적인 문제점을 도출하고 개선방안을 모색한 결 과 다음과 같은 개선방안이 강구되었다. 첫째로, 생활대책의 내용의 형평성을 확보하기 위해서는 ｢공익사업을 위한 토지 등의 취 득 및 보상에 관한 법률｣에 생활대책의 수립·실시에 관한 근거 규정을 신설하여야 한다. 둘째로, 생활대책대상자의 형평성을 확보하기 위해서는 생활대책대상자의 범위를 협의 계약을 체결하고 스스로 이주한 자에 한정시키지 않고 수용재결을 받은 자도 포함시켜야 한다. 마지막으로, 이주민들이 다른 업종의 직업으로 원활하게 전환할 수 있도록 지원하기 위 해서는 우선고용·취업알선에 앞서서 전문적인 직업훈련이 선행되어야 한다.
