Purpose : The purpose of this study was to rule on the legal interpretation and aspects of sinking of sewol sea, to clarity lack of unseaworthiness of the Sewol sea and wilful misconduct of the assured. Research design, data, methodology : Literature review and analyzed Seoul High Court Decision 2017Na2071933 decided on November. 16, 2018. Results : First, legal interpretation of any latent defect in the machinery and the ship's unseaworthiness was examined. Second, legal interpretation of the ship's lack of unseaworthiness at the time of expansion and renovation was explored. Lastly, the legal interpretation of the flight management regulations, sailling process, lack of unseaworthiness of the Sewol sea was analyzed. Conclusions : The proximately of sinking of the Sewol sea should be attributed to the wilful misconduct of the assured rather than the sewol sea.‘s lack of unseaworthiness.

세월호가 침몰 됨에 따라 청해진해운에게 대출을 한 한국산업은행이 메리츠화재해상보험주식 회사와 한국해운조합에게 각각 7,771,000,000원과 3,600,000,000원의 보험금 지급 청구 소송에 대한 서울고등법원의 판례를 분석하여 서울고등법원의 법리적 해석의 문제점을 제시하였다. 서울고등법원은 피보험자인 청해진해운이 세월호가 감항능력이 결여되었다는 것을 알고 세월 호를 운항하다 세월호를 침몰시켰기 때문에 보험자는 보험금을 지급할 책임이 없다고 판시하 였다. 서울고등법원이 세월호가 침몰한 근인을 세월호의 감항능력 결여로 법리적 해석을 하였 다. 한국선급협회가 승인한 조건으로 운항하였을 경우에는 세월호의 감항능력이 결여되지 않 았다는 주장도 존재하기 때문에 서울고등법원은 잘못된 법리적 해석을 하였다. 세월호 침몰의 근인은 피보험자의 불법행위로 법리적 해석을 하여야 한다. 청해진해운은 세월호의 증⦁개축의 인⦁허가절차에서부터 세월호의 운항에 이르기까지 온갖 불법행위를 자행하였고 이러한 불법행위가 세월호를 침몰시키는 근인이 되었다. 세월호가 감항능력이 결여되었다는 주장에 대해서 찬성과 반대가 존재하지만 청해진해운의 불법행위에 대해서는 모든 연구자가 동의하 였다. 따라서 세월호 침몰의 근인은 피보험자의 불법행위로 법리적 해석을 하여 보험자에게 면책을 주어야 한다.
