China’s “marriage law” is regarded as a long-term independent separate law, and the “status relationship and property relationship” stipulated in the civil law only has formal significance. On May 28, 2020, the Third Plenary Session of the 13th National People’s Congress of China passed the “Civil War of the people’s Republic of China” composed of “general provisions, property rights, contracts, personality rights, marriage and family, inheritance, illegal liability” and “Supplementary Provisions”, which is expected to be implemented from January 1, 2021. After more than 70 years of independent operation, China’s marriage law has finally returned to the civil war and made a decisive step. The content of Chinese civil law is worthy of its name. The chapter of marriage and family in the biography of civil law of China is sorted out according to certain specifications in marriage law, adoption law and its judicial interpretation revised in 2001. The reform of the system mainly focuses on marriage, adoption, especially divorce. However, in terms of the system, this article has a strong trace of simply putting the laws together. In terms of content, it has not widely accepted the effective provisions in judicial practice, nor has it correctly reflected the trend of modern marriage law in the 21st century in terms of legislative values. The chapter of marriage and family in the biography of civil law of China should properly coordinate the conflicting values of modern marriage and family law, accept mature legislation through effective judicial interpretation and comparative law investigation, and realize the systematic and scientific legislation of marriage and family convenience. Therefore, this study will discuss China’s marriage and family system from the aspects of marriage and family convenience system and content in the civil law biography of China, and put forward improvement plans for its complete legislation.

중국 ｢혼인법｣은 오랫동안 독립된 단행법으로 간주되어 민법이 규율하고 있 는 “신분관계와 재산관계”는 형식적인 의미만 가지게 되었다. 2020년 5월 28일 중국 제13기 전국인민대표대회 제3차 전체회의에서는 표결을 통하여 “총칙”, “물권”, “계약”, “인격권”, “혼인가족”, “상속”, “불법책임”과 “부칙” 등으로 구성 된 ｢중화인민공화국 민법전｣을 통과시키었고 이는 2021년 1월 1일부터 시행되 고 있다. 중국 ｢혼인법｣은 법전을 떠나 독립적으로 운행 된지 70여년 만에 민 법전으로 복귀하는 결정적인 발걸음을 내디딤으로써 중국민법 규범내용이 명 실상부하였다. 중국 ｢민법전｣ 혼인가족 편은 2001년 개정 ｢혼인법｣, ｢입양법｣ 과 그 사법해석을 일정한 규격에 맞게 정리한 것으로 그 제도의 변혁은 주로 결혼, 입양, 특히 이혼 부분에 집중되어 있다. 그러나 본 편은 체계 면에서 단 순히 법률을 한데 모아 편성한 흔적이 농후하고 내용 면에서 사법실천에 있어 서 효과적인 규정들을 폭넓게 받아들여 채택하고 있지 아니하며 입법적인 가 치이념에서도 21세기 현대 혼인가족법의 흐름을 제대로 반영하지 못하고 있 다. 중국 ｢민법전｣ 혼인가족 편은 마땅히 현대 혼인가족법의 서로 충돌되는 가치이념을 적절히 조화시키고 효과적인 사법해석과 비교법적인 고찰을 통한 성숙한 입법을 채택하여 혼인가족 편의 체계적이고 과학적인 입법을 실현하여 야 한다. 따라서 본 연구는 중국 ｢민법전｣ 혼인가족 편의 체계와 내용으로부터 중국 혼인가족법의 최근 입법동향에 대하여 논의하고 현대 혼인가족법의 가치 이념에서 출발하여 중국 혼인가족법이 향후 해결하여야 할 과제를 제시한다.
