The management of assembly and demonstration in the modern society is not possible through the top-down management of the state in the past, but through cooperation, moving away from the command and control method. It is moving toward the direction of guaranteeing freedom. In the area of police administration, atypical administrative activities such as in assembly, compliance of traffic regulations, and victim protection, have been increasing, shifting a paradigm from regulations to persuasion and incentives. This is why the principle of cooperation is more important. The Korean Police operate “Dialogue Police”, “Assembly Demonstration Advisory Committee”, “Citizen Observer Group”, and “Compliance Memorandum of Understanding”. However, these systems expose various problems, and thus countermeasures are needed. To ensure that the system for such cooperation can be practically operated, (1) the provisions of the principle of cooperation need to be introduced in the Act on Assemblies and Demonstrations. Through this, it is of importance to elicit (2) cooperation between the organizers of the assembly and the police, and (3) cooperation with citizens in the position of third parties.

현대사회에서의 집회시위관리는 과거의 국가의 하향적 관리가 아닌 국민과 동등한 위치에서 자유 보장 방향으로 나아가고 있으며 이는 명령과 통제의 방식에서 벗어나 협력을 통해서만 가능하다. 경찰 행정영역 역시 집회, 교통 법규 준수 및 피해자 보호 등의 영역에서 비정형적 행정행위가 늘어나면서 규제 중심에서 설득 및 유인 방향으로 패러다임이 변화하고 있으며 이에 따라 ‘협력의 원칙’이 더욱 중요해졌다. 현재 집회제 도에서 협력 관련 제도로는 미국의 시민참관단, 스웨덴 등 유럽의 대화경찰 제도가 있 으며, 우리나라 역시 대화경찰과 집회시위자문위원회, 시민참관단, 준법집회 양해각서 를 운용하고 있다. 하지만 이 제도들은 여러 가지 문제점을 노출하고 있고 이에 대한 대책이 필요하다. 이러한 협력을 위한 제도가 실질적으로 운용될 수 있도록 (1)‘집회및 시위에관한법률’에 협력의 원칙 조항 도입하여 (2)집회 주최 측과 경찰의 협력과 (3)제 3자 위치의 시민을 통한 협력을 이끌어내는 것이 중요하다.
