In this paper, after defining the concept of Extra-territorial Search and Seizure of Digital Information, we investigated legislative cases and precedents related to Extra-territorial Search and Seizure of Digital Information. Major issues were analyzed through legislative cases and precedents. In addition, investigation procedures for Extra-territorial Search and Seizure of Digital Information were presented. Our Supreme Court judged that Extra-territorial Search and Seizure of Digital Information was an acceptable method of seizure under the Criminal Procedure Act in the SINA.COM e-mail seizure case. Extra-territorial Search and Seizure of Digital Information refers to the issue of the search location in Articles 109 and 114 of the Criminal Procedure Act, the issue of the participation of the person in charge of Article 123, the issue of the subject of the warrant for seizure and search in Article 118, and Article 129 issuance of a list of seizure. There are legal issues such as the subject matter. As the Supreme Court recognizes the legality of Extra-territorial Search and Seizure of Digital Information, it is expected that Extra-territorial Search and Seizure of Digital Information will be actively used in investigation practice. There are also issues of due process, but at a minimum, measures should be taken to ensure the authenticity of the evidence. In order to secure the authenticity of digital evidence collected through Extra-territorial Search and Seizure of Digital Information, the following measures should be prepared. The digital forensic professional witness system should be operated by an objective and neutral digital forensic professional institution. In selecting a third place for Extra-territorial Search and Seizure of Digital Information, the legislative purpose of Article 123 of the Criminal Procedure Act should be reflected as much as possible. Choose a professional and neutral place. In addition, prior to seizure and search, the network environment of the seizure and search site must be checked. Digital forensic tools should also use proven tools.

본 논문에서는 역외 디지털정보 원격 압수･수색에 대한 개념을 정립한 후, 역외 디지털정보 원격 압수･수색과 관련된 국내외 입법례와 판례를 살펴보았다. 국내외 입법례와 판례를 통해 주요쟁점을 분석한 후, 역외 디지털정보 원격 압수･수색을 위한 수사절차를 제언하였다. 우리 대법원은 시나닷컴 이메일 압수사건에서 역외 디지털정보 원격 압수･수색 이 현행 형사소송법상 허용 가능한 강제처분으로 판단하였다. 역외 디지털정보 원 격 압수･수색은 형사소송법 제109조 및 제114조의 수색 장소의 문제, 제123조 책 임자 참여권의 문제, 제118조 압수･수색 영장제시 대상의 문제, 제129조 압수목록 교부 대상의 문제 등 법률적 쟁점이 여전히 존재한다. 대법원이 역외 디지털정보 원격 압수수색의 적법성을 인정함으로써 수사실무에서는 이와 같은 압수･수색 방 법이 적극적으로 활용될 것으로 예상된다. 적법절차에 대한 논란을 떠나, 최소한 증거의 진정성 확보를 위한 조치가 마련되어야 한다. 역외 원격 압수수색을 통해 수집된 디지털증거의 진정성을 확보하기 위해서는 다음과 같은 방안이 마련되어야 한다. 객관적이고 중립적인 디지털포렌식 전문기 관에 의해 디지털포렌식 전문입회인 제도를 운영해야 한다. 역외 디지털정보 압 수･수색을 위해 제3의 장소를 선정함에 있어서는 형사소송법 제123조의 입법취지 를 최대한 반영하여, 전문적이고 중립적인 장소를 선정해야 한다. 또한 압수･수색 이전에 압수･수색 장소의 네트워크 환경을 확인하고, 압수･수색 시 사용되는 디지 털포렌식 도구도 검증된 도구를 사용해야 한다.
