In Korea, even after the enactment of the Special Act on Prostitution (“Act”) and despite the Constitutional Court's decision upholding the constitutionality of the provisions of the Act that criminalize prostitution agreed upon by adults, the central issue of whether prostitution should be condemned as a crime remains deeply unsettled, it still being the source of great controversy and fierce debate. This study aims to ascertain how such controversy and debate surrounding decriminalization of prostitution in Korea may be overcome and seeks to propose ways in which Korea’s laws on prostitution may be improved. This study first presents that persistent debates in Korea on the topic of prostitution highlight the shortcomings of morality policy and suggests that the issues stemming from prostitution be approached with a more pragmatic and humane attitude. It then considers differing types of laws and policies concerning prostitution according to specific classifications, namely repressivism based on moral conservatism, repressivism based on radical feminism, restrictivism, and integrativism. Further, this study analyzes Korea’s prostitution-related laws from the perspectives of criminal law, social welfare law, and health law, while also examining its drawbacks in terms of effectiveness, human rights protection and coherence. Based on such analysis and examination, this study finds that Korea's prostitution-related laws are ineffective, leave much to be desired for human rights protection, and are fraught with serious internal contradictions. This study concludes by proposing that, in order to improve Korea’s prostitutionrelated laws in a practical, humane and coherent manner, it would be necessary for the system to shift away from repressivism to restrictivism or integrativism. Decriminalization of prostitution agreed upon by adults would no doubt be the first step in the right direction for such improvement.

한국에서는 성매매특별법이 제정된 이후에도, 그리고 성인들이 합의하여 행하는 성매매를 범죄로 금지하는 법조항이 합헌이라고 하는 헌법재판소 결정이 있었음에도 불구하고 성매매를 범죄로 금지해야 하는지를 두고 논란이 많다. 이 연구는 성매매 비범죄화를 둘러싼 논란이 치열하면서도 경색되어 있는 상황을 타개하고 한국 성매매법제의 개선방향을 모색하고자 한다. 그래서 먼저 오늘날 한국에서 성매매에 관한 논의가 도덕정책에서 나타나는 폐단을 여실히 보여주고 있으며, 이 문제를 실용적이고 인도적인 태도로 접근하는 것이 바람직하다는 점을 확인한다. 그리고 성매매에 관한 법과 정책의 유형을 도덕적 보수주의에 기초한 금압주의, 급진 여성주의에 기초한 금압주의, 관리주의, 통합주의로 나누어서 고찰한다. 그런 다음 한국의 성매매법제를 형사법제, 복지법제, 보건법제로 나누어서 개관하고, 그 문제 점을 실효성과 인권보호 및 내적 정합성의 면에서 살펴본다. 그 결과로 한국의 성매매법제는 실효성이 낮고, 인권보호에 미흡하고, 내적으로 모순이 심하다는 문제를 확인한다. 이런 고찰을 바탕으로 한국 성매매법제를 실용적이고 인도적이며 정합적으로 개선하기 위해 서는 금압주의를 버리고 관리주의나 통합주의로 나아가야 한다는 것, 그리고 그 출발점으로 성 인들이 합의하여 행하는 성매매를 비범죄화해야 한다는 것을 결론으로 제시한다.
