The enterprise credit supervision is a kind of government action which takes the form of collection, evaluation, publicity, sharing and application of the credit information of enterprise, and in which the status of good faith obeyed the law of the enterprise is regarded as an important reference factor. The application of credit information of enterprise in administrative supervision is not a new subject in the scope of the world. The government departments of credit reporting countries such as America and Britain also pay great attention to the status of compliance of enterprise. Due to the factors of politics, economy, culture, law and technology and so on, the perfecting of enterprise credit supervision legal system must be a gradual and persistent progress. At present, there are 21 central government departments which have developing enterprise credit supervision and enacted departmental legislation in China, and all the provinces have built local platforms of enterprise credit supervision, and 24 provinces have enacted provincial legislation, and China has built two national platforms of enterprise credit supervision which are the national credit information of enterprise public system and the national credit information sharing platform. The enterprise credit supervision legal system which is in the guidance of national legislation and policy and in the leading of local legislation and departmental legislation has gradually formed in China. The existing research generally pays more attention to certain specific problem, lacking of systematic study and weak in legislation research. This Paper, through hackling the legislations of enterprise credit supervision in China, analyzes the macroscopic and microscopic main problems in the legislations of enterprise credit supervision in China and puts forward the macroscopic and microscopic perfecting way of the legislations. The enterprise credit supervision legislation is a systematic project concerning the benefit conflict and balance of multiparty, which needs persistent theoretical research and system perfection. This Paper which may be regarded as pandect of research on the enterprise credit supervision legislation in China, not only has positive meaning in the perfection of the enterprise credit supervision legislation in China, but also lays good foundation for the subsequent research on the concrete legislative issues.

중국의 기업에 대한 신용감독 및 관리제도는 정부가 공공행정영역에서 기업의 준법의지를 감독관리하는 중요한 업무 중 하나이다. 이러한 정부의 기업에 대 한 신용 감독 및 관리는 기업의 신용정보를 수집하고평가하며, 이를 공개하여 일반 대중이 공유하게 한다. 세계적 시각에서 보면 기업의 신용정보가 행정영 역에서 관리감독되어야 하는지가 문제로 되는데, 미국과 영국 등은 증권정보가 비교적 중요하고 그 활용도가 높은 국가에서는 정부의 기업에 대한 신용정보의 관리를 매우 중요하게 여기고 있다. 정치, 경제, 문화, 법률, 기술 등의 요소로 인한 영향으로 기업정보의 감독과 관리에 관한 법률제도의 정비는 반드시 필요한 것이다. 오늘날 중국은 이미 21 개의 국가감독관리부문이 기업신용감독관리에 관한 입법을 마련하고 있으며, 모든 성(省)들도 기업의 신용감독관리에 관한 지방플랫폼을 마련하여 24개 성 에서 성급 입법을 마련하였다. 국가는 전국 기업신용정보 공시시스템과 전국 신용정보 공유 플랫폼을 통해 투트랙으로 기업의 신용정보를 감독관리하고 있 다. 이는 국가의입법과 정책을 필두로 지방입법과 부문입법을 통해 기업신용감 독관리 법률시스템을 형성하였다. 일반적이고 총론적인 측면에서의 기업의 신용정보에 대한 감독관리제도에 대 한 어떤 구체적인 문제는 현재 중국에서 많은 연구가 진행되었다. 하지만 기업 의 신용정보의 감독관리에 대한 시스템적 연구에 대하여는 아직 많은 연구가 진행되지 않은 상태이며, 특히 입법문제에 대하여는 미진한 상태이다. 그러므로 본 연구는 중국의 기업신용감독관리 입법현황을 통하여 현재 중국기업의 신용 감독관리 입법에 대한 거시적 및 미시적 면에서 존재하는 문제를 분석한다. 이 를 통해 나타난 문제점들에 대하여 해결방안을 제시함으로써 기업신용감독관리 의 다양한 입법주체 간의 이익충돌이나 형평성문제들을 해결할 수 있을 것으로 기대된다. 또한 본 연구는 중국 기업신용의 감독관리 입법에 대한 총론적 연구 로 이 분야의 후속연구에 있어 기초적 자료로 활용될 것이라 본다.

企业信用监管是指政府将公共行政领域中的企业诚信守法状况作为行政监管 的重要参考因素或监管的依据，具体表现为政府对企业信用信息进行归集、评 价、公开、共享和应用等。从世界范围看，企业信用信息在行政领域的应用并 不是个全新的课题，美国、英国等征信国家的政府部门在行政管理中亦十分重 视企业合规度信用。 由于政治、经济、文化、法律和技术等因素的影响，企业信用监管法律制度 的完善必然是一个渐进和持续的过程。目前，中国已有21个国家监管部门开展 企业信用监管并出台部门立法，所有省份均搭建了企业信用监管地方平台并有 24个省份出台了省级立法，国家建立了全国企业信用信息公示系统和全国信用 信息共享平台两个企业信用监管全国性平台，逐步形成了以国家立法和政策为 引导、以地方立法和部门立法为主导的企业信用监管法律体系。 已有研究一般侧重就企业信用监管制度的某一具体问题展开研究，没有体系 化的系统研究，立法问题的研究薄弱。本研究通过对中国企业信用监管立法现 状的梳理，分析当前中国企业信用监管立法在宏观和微观方面存在的主要问 题，提出宏观和微观方面的立法完善路径。企业信用监管立法是一项涉及多方 主体利益冲突及其平衡的系统工程，需要进行持续的理论研究和制度完善。本 研究可作为中国企业信用监管立法研究的总论，不仅对中国企业信用监管立法 的完善具有积极意义，同时可为后续具体立法问题的研究奠定良好的基础。
