There are general religious education penalty and bureaucratic general education penalty in education penalty as correction ideology for inmates. Due to its long history and the universality of religious education penalty by prison-chaplin, implemented by all countries, the full-time prison-chaplin system has been implemented in developed countries. In korea, there was a Buddhist full-time prison chaplin during the Japanese colonial period and Christian full-time prison chaplin under president Syngman Rhee. But full-time prison chaplin has been abolished due to its political character and religious specificity and non-full time prison chaplins(a member of the prison’s religious committee) the role is replacing as religious correction for inmates. The limitation of religious correction for inmates by non-full time prison chaplin have been pointed out due to various problems such as non-professionalism and unstructural character, merchandising, capitalization shortness of non-full time prison chaplin as unpaid part-time jobs. Although the religious community has been campaigning for the introduction of the full time prison chaplin like a korean military chaplin, they has no theoretical basis of introduction of full time prison chaplin system in korean correction system because of its emotional and religious nature. Existing studies for introduction of it also insist on the legitimacy of it, but have a limitation of not providing scientific, legal grounds and practical strategies. Therefore, I asserted a practical strategy for its legislation and the necessity of it with aim of providing the basis for the realization of the full time prison chaplin in korean correction system with the interdisciplinary approach and my original approach.

수용자에 대한 교정이념인 교육형주의(敎育形主義)에는 관료적 성격의 일반교 육형주의와 종교적 성격인 종교교육형주의가 있다. 교종(矯宗)에 의한 종교교육 형주의는 오랜 역사와 모든 국가가 시행하는 보편성으로 인해 선진국은 전임 교 종제도가 시행되어 왔다. 우리나라도 일제강점기 때는 불교적 전임교종제가 있었 고 이승만 대통령 때는 기독교적 전임 교종제도가 있었으나 교종의 정치성과 종교적 특정성으로 인하여 제2공화국 이후 폐지되어 비전임 교종인 종교위원이 수 용자에 대한 종교교화를 해오고 있다. 그러나 무보수의 파트직인 비전임 교종의 비전문성, 비체계성, 단편성, 종교적 상품화와 자본화 등의 여러 문제점과 이로 인한 종교교화의 한계 등이 지적되어 왔다. 이에 따라 종교계에서는 교정시설에 군종(軍宗)처럼 전임 교종제의 도입을 위 한 운동을 해왔으나 감성적, 종교적인 구호적 성격에 그쳐 이론적 근거를 제시하 지 못하고 있다. 학계의 선행연구들도 전임 교종제도의 당위성을 주장하지만 추 상적인 당위론에 그쳐 과학적, 법적 근거와 이에 따른 실천전략을 제시하지 못하 는 한계가 있다. 따라서 본 논문에서는 전임 교종제도의 필요성과 그 법제화의 실현을 위한 실천적 전략을 제시하여 과학화된 전임 교종제의 실현을 위한 정책 적 기초를 제공하는 목적으로 학제적 방법으로 독창적으로 서술하였다.
