There has been a contention in the past that the damage caused by the excessive occurrence of by-elections should be reduced as much as possible by reducing the indiscriminate occurrence of by-elections. However, existing views focusing on reducing the frequent implementation of by-elections, cannot be harmonized with the Constitution. In order to solve this problem, it is necessary to find a solution that is different from the existing views from a new point of view. The author proposes to introduce a “Public Official Performance Deposit” system from the standpoint of legislative policy, which requires elected officials to deposit public official performance deposit to the Election Commission before the term begins in order to resolve the excessive occurrences of by-elections. The details of the “Public Official Performance Deposit” system that conforms to the Constitution are as follows. First, it is appropriate that the person who should deposit the public official performance deposit shall be an elected public official and he or she should deposit it to the Election Commission before taking office. Second, the principal reason for the return of the Deposit shall be in the case where an elected public official has performed the public office until the expiration of his/her term of office in consideration of the purpose of the system. It is desirable to set the case of death from a disease or accident as an exceptional reason for return. Third, the Deposit should be in principle returned upon the expiration of the relevant public office. However, if the relevant public official holds the position and runs for the next election, it is necessary to return it until the candidate is registered.

재·보궐선거의 무분별한 발생을 억제하여 재·보궐선거의 빈발로 인한 폐해를 가 능한 한 줄여야 한다는 주장은 과거부터 존재하였다. 하지만 기존의 견해들은 재· 보궐선거의 빈번한 실시를 줄이기 위한 목적에 치중한 나머지 헌법과 배치되거나 헌법과 조화를 이룰 수 없는 문제점을 내포하고 있었다. 이러한 문제를 해결하기 위하여 새로운 관점에서 기존의 견해와는 접근법을 달리하는 해결방안을 모색할 필요가 있다. 재·보궐선거의 빈발과 이로 인한 문제점을 해소하기 위하여 저자는 선출직 공무원으로 하여금 해당 공직의 임기 개시 전까지 공직수행 보증금을 관할 선거관리위원회에 기탁하도록 하고 그 공직의 임기 만료 시까지 중도 이탈 없이 공직을 유지·수행한 경우에는 기탁한 공직수행 보증금을 반환하도록 하는 ‘공직수 행 보증금’ 제도를 입법정책적 측면에서 도입할 것을 제안한다. 헌법에 합치되는 ‘공직수행 보증금’ 제도의 구체적인 내용은 다음과 같다. 첫째, 공직수행 보증금을 기탁하여야 할 대상자는 선출직 공무원으로 하며 보증금의 액수는 공직선거에서 후보자등록 시 요구되는 기탁금의 액수와 동일하게 설정하여 공직 취임 전까지 관 할 선거관리위원회에 기탁하도록 하는 것이 적절하다. 둘째, 공직수행 보증금의 반 환사유는 제도의 취지에 비추어 선출직 공무원이 해당 공직을 임기만료 시까지 수 행한 경우를 원칙으로 하면서도 질병이나 사고로 인한 사망(형사책임이나 징계책 임을 회피하기 위해서 자살한 경우는 제외)의 경우를 예외적 반환사유로 설정하는 것이 바람직하다. 셋째, 반환의 시기는 해당 공직의 임기만료 시에 반환함을 원칙 으로 하되 당해 공무원이 그 직을 보유한 채 임기만료에 의한 차기 선거에 입후보 하는 경우에는 후보자 등록 시까지 반환하도록 할 필요가 있다.
