The registration forms of environmental impact assessment in China has undergone the development process from examination and approval system to recordation system. The previous examination and approval system has made outstanding contributions to China’s environmental impact assessment system, and the disadvantages and deficiencies showed in practice have promoted the reform of recordation system. In the reform process of recordation of registration forms on environmental impact, the role of previous examination and approval system shall be clear, and the reasons for recordation system reform should also be clear while defining the legal development vein. The legal nature of the recordation behavior on environmental impact registration forms is the basis and premise of correctly understanding the recordation system. The recordation behavior shall be unilateral behavior, administrative factual behavior and administrative procedural behavior. In the implementation process of recordation of registration forms on environmental impact, many problems have gradually emerged, such as arbitrary filing phenomenon, cheating phenomenon, lower the environmental impact assessment grade purposely, default on the recordation commitment, and low public participation. In order to effectively solve the realistic dilemma of recordation of registration forms on environmental impact, and under the correct understanding of “devolution, management and service” as premise, this paper put forwards countermeasures from enterprise entity, government duty and third party power these three aspects, to simplify the process, to fully reflect the freedom and responsibility of enterprises, to strengthen the supervision during and after operation, to fully perform the government supervision duties and improve the service methods, where to reflect the specific countermeasures on public service responsibility of government. China environmental impact assessment system draws the advanced system experience of South Korea in the development and improving process. While stimulating the development of system, it also promotes the international communication and further consolidate the friendly relations between China and South Korea.

중국의 환경영향평가등기표는 심사제에서 등록제로 발전하는 과정을 거쳤다. 이전 의 심사제는 중국의 환경영향평가제도에 큰 기여를 했지만, 실무에서 나타난 폐단과 여러 문제점들로 인하여 등록제 개혁을 추진하기에 이르렀다. 이에 환경영향등기표 등록제도의 개혁과정에서 이전 심사제의 중요한 역할을 명확히 하고, 법률발전의 맥락 을 규명하는 동시에 등록제 개혁의 원인을 명확히 찾아낼 필요가 있다. 한편, 환경영향등기표 등록제의 법률성질은 해당 등록행위가 일방행위, 행정상의 사 실행위, 행정절차행위라는 점이 매우 중요하다. 이때 환경영향등기표 등록제도를 실시 하는 과정에서 자의신고, 허위조작, 환경영향평가등급의 자의적 절하, 등록공약 불이 행, 시민참여도 저하 등의 문제점이 점차 나타나고 있다. 본 연구는 이러한 점에서 환경영향등기표 등록제의 현실적 어려움을 효과적으로 해 결하기 위하여 “팡관푸(放管服)”를 정확히 인식 및 이해한다는 전제하에서 기업주체, 정부직능 그리고 제3자 역량 등 세 방면의 주체를 통해 절차의 간소화를 제시하였다. 이를 통해 기업주체의 자유와 책임을 충실히 구현하고, 사후감독을 강화하며, 정부 규 제 및 서비스의 최적화, 정부의 공공서비스 책임의 충실화 등 구체적인 개선방안을 제시하였다. 본 연구를 통해 중국 환경영향평가제도가 보완 및 발전하는 과정에서 한 국의 선진제도의 경험을 참고하여 제도 발전을 추진하는 동시에 한중 양국의 국제교류 를 향상시키고, 양국 간의 우호관계를 공고히 하는데 도움이 될 것이라 본다.

中国环境影响评价登记表经历了审批制到备案制的发展过程。此前的审批制对中国 环境影响评价制度做出了突出贡献，其在实践中凸显的弊端与不足推动了备案制的改 革。在环境影响登记表备案制的改革过程中应明确此前审批制的作用，在明晰法律发展 脉络的同时明确备案制改革的原因。环境影响登记表备案行为的法律性质是正确认识备 案制的基础和前提，该备案行为应为双方行政行为、羁束行政行为、行政事实行为与行 政程序性行为。在环境影响登记表备案制实施的过程中，逐渐凸显出肆意填报现象、弄 虚作假现象、擅自降低环境影响评价等级、不履行备案承诺以及公众参与度较低等问 题。为有效解决环境影响登记表备案制的现实困境，在正确认识与理解“放管服”的前提 下，从企业主体、政府职能和第三方力量三方面主体入手，提出了简化流程，充分体现 企业主体自由和责任、加强事中事后监管，充分履行政府监管职责以及优化服务方式， 充分体现政府公共服务责任等具体完善对策。中国环境影响评价制度在发展完善的过程 中借鉴了韩国的先进制度经验，在促进制度发展的同时，有利于提升中韩两国的国际交 流，进而巩固两国间的友好关系。
