With the recent incidentts of child abuse in Cheonan, Chungnam and Yangcheon-gu, Seoul, the child abuse problem has again become a shocking issue in our society. These incidents were both in-home abuse deaths cases committed by step-parents or adoptive-mothers, and could have been prevented, so if proactive measures were taken. by means of the fact that reports of abuse were received prior to the occurrence and investigations were conducted, For this reason, many criticisms have been made on the process of dealing with abuse cases, as well as arguments that a re-examination of the fundamental solutions to child abuse is necessary have been asserted. Therefore, in this paper, I am going to analyze the problems of current social, legal and policy countermeasures discovered through a series of recent incidents of abuse death, and propose the improvement plan. Problems with the current countermeasures include the still lack of awareness of seriousness, legislative problems such as flaws in relevant laws and regulations and the problems of re-abuse due to early return to victims. Forward, as a way to improve, it described the shift in perception of child abuse, the introduction of an immediate separation system, supplementation of related regulations, expansion of child abuse prevention policies such as parental education and early detection of abuse, and establishment of a response system through organic cooperation with related organizations.

최근 발생한 충남 천안과 서울 양천구의 아동학대치사사건을 계기로 아동학대 문제는 다시금 우리 사회 의 충격적 이슈가 되고 있다. 이들 사건들은 계부모나 양모 등에 의해 자행된 가정내 학대사망사건이라는 점과 사건발생 이전에 학대신고가 접수되어 관련 조사가 이루어진 사건으로서 적극적인 개입이 이루어졌 었더라면 사망이라는 결과를 충분히 방지할 수 있었다는 공통점을 가지고 있다. 이러한 이유로 학대사건 처리과정에 대한 많은 비판과 함께 아동학대의 본질적 해결방안에 대한 근본적인 재검토가 필요하다는 주장이 제기되고 있다. 이에 본 논문에서는 최근 발생한 일련의 학대치사사건을 통해서 밝혀진 사회적·법 적·정책적 측면에서의 대응방안의 문제점을 분석해 보고 이에 대한 개선방안을 제안해보고자 한다. 현행 대응방안의 문제점으로는 여전한 심각성 인식의 부족과, 관련 법규정의 미비와 같은 입법상의 문제점, 피해가정으로의 조기복귀로 인한 재학대 문제 등을 분석해 보았고 그 개선방안으로는 아동학대에 관한 사회인식의 전환, 즉각 분리제도의 도입 및 관련규정의 보완, 부모교육과 학대조기발견과 같은 아동학대 예방정책의 확대, 관계기관의 유기적 협력을 통한 대응시스템 확립 등을 기술하였다.
