In this article I examined the changes of Jail system and of treatment of prisoners before and after in the period of Kabo-Kwangmu Reformation, by considering differences between the articles of the new and old codes in the aspect of legal system, and by reviewing the documents such as judicial records, local ethnography and old maps in Jeonlabukdo province. The changes of judicial system in modern Korea is composed of the aggressive intention of Japanese imperialism and the patriotic purpose of Enlightened Party. In general it has many similarities of accepting the European jail system between in the Japanese Maiji Reformation and in modern Korea. Especially the acceptance of the penal servitude system was followed by the division of prison between the convicted prisoners’ and the unconvicted. And it has brought about the changes such as paying the wages of the convicted and the active self-realization through the prisoner’s reading of culture, moral, occupation books and doing regular exercise, and as a result of these changes, it was possible that the modern penal and jail system focusing on enlightenment and discipline. It has also led to the change of execution method that the decapitation and dismemberment were replaced by hanging and firing squad. By this change, we are able to know the development of the prisoner’s right. In the province of Jeonlabukdo, owing to the often instructions and answering order for the fair trial by Ministry of Justice, it was possible that all the judicial processes had got the fairness and objectivity according to the new penal system, abolishing the old judicial custom of vague standards. And the new legal system has put the strict restriction on the use of implement of fastening and punishing the prisoners. Very often the government declaimed act of oblivion for the convicted and the unconvicted, for the sake of participating with the national celebration and the reforming politics. The kinds of oblivion was various such as parole, temporal release, reduction of penalty. As a result of these managements, the human right of prisoners in jail has considerably improved in the province of Jeonlabukdo. But in the aspect of advancing the level of penal servitude, it was still lacking and insufficient to give the food and wages for working for prisoners, like any provinces at the period. We can see the transitional character of provincial underdevelopment in the judicial system, in comparison with the capital and some advanced open port, in the aspect of facility modernization and of gaining funds in 1890s in Korean empire.

본고는 조선후기 사회의 중세적 감옥행정과 죄수에 대한 처우가 갑오～광무개혁 기를 거치면서 어떠한 변화를 겪게 되었는지, 그 법제적 변화를 신구법전의 고찰을 통해서 파악하고, 실행의 사례를 전북지역의 재판기록과 읍사례, 고지도 등의 자료 를 통해서 고찰해본 글이다. 한국 근대 감옥제도의 변화는 개화파의 순수한 개혁의 지와 일본제국주의의 침략적 의도가 혼재된 상황에서, 일본이 명치유신 이후에 도 입한 서구의 감옥제도와 그 대체적 특징을 같이한다고 보여진다. 특히 형벌제도가 신체형에서 자유형으로 바뀌는 것을 상징적으로 대변하는 징역형(懲役刑)의 실시는 기결감(旣決監)과 미결감(未決監)의 구분을 수반했고, 징역죄수에 대한 일정한 비용 지급과 운동, 교양 및 수신, 직업 서적의 독서를 통한 자기개발의 허용 등을 적극적 으로 인정하면서 처벌보다는 교화와 훈육에 중점을 둔 근대적 형벌 및 감옥제도의 시행이 가능하게 되었다. 또한 사형의 방식에서 참수형(斬首刑)과 능지형(凌遲刑)이 사라지고 그 대신에 민간인에게는 교수형(絞首刑), 군인에게는 총살형(銃殺刑)만 실 시되었는데 이 또한 인권개선의 측면에서 진일보한 것이라고 할 수 있다. 전북지역 의 경우, 공정한 재판을 위한 법부의 잦은 훈령과 지령을 통해서 신법령에 따른 재 판의 모든 과정이 계도되었고, 구습에 따른 막연한 판결이 아닌 분명한 근거에 따 른 객관적 판결을 지향했다. 또 새로운 법령에 따라 수인에게 형구(刑具)를 착용하 는 경우를 엄격히 제한했고, 판결 연기에 따른 체옥의 고충을 개선하기 위해서 보 방(保放), 석방(釋放), 감형(減刑) 등 각종 사면령의 혜택도 여러 차례 내렸다. 이러 한 사실들은 갑오～광무개혁기 전북 지역 수인들의 기본적 인권을 보장하는데 적 지 않은 도움이 되었다. 그러나 감옥 시설의 개선을 통한 수감생활의 향상이나, 충 분한 식량의 공급과 징역에 따른 노임의 제공 등은 전북의 경우에도 다른 지방의 감옥들과 마찬가지로 불충분하고 부족한 상태였다. 이는 곧 감옥 시설의 근대화와 재정의 확보라는 측면에서 1890년대 한국사회의 서울과 지방의 차이를 반영하는 것으로, 감옥제도의 근대화 과정에서의 과도적 모습의 하나로 해석된다.
