This study is focused on defects liability system on multi-family housing. The Civil Code, Act on Ownership and Management of Condominium Buildings, and Multi-Family Housing Management Act apply to multi-family housing. However, each of these laws has different purposes and areas of regulation, and the overlapping application of these laws to buildings led to confusion in the interpretation and application of the law. Therefore, in a situation where the Act on Ownership and Management of Condominium Buildings and Multi-Family Housing Management Act are applied, the defect security liability provisions of both laws should be interpreted and applied harmoniously. However, In the Multi-Family Housing Management Act, revised in 2017, there was a new legislation beyond the previous discussion that granted the right to claim damages at the Resident Representative Meeting, and this requires a new interpretation according to the revised Act.

공동주택이면서 집합건물인 건물에 적용되는 법률로서 중요한 것은 민법, 집합건물법, 공동주택관리법 등이 있다. 그런데 이러한 법률들은 각기 그 규정 목적과 영역을 달리하는데, 공동주택이면서 집합건물인 건물에 대하여 이러한 법률들이 중첩적으로 적용됨으로서 법해석과 적 용에 혼선이 있었고, 이는 공동주택의 하자담보책임 문제에 있어서 두 드러진다고 할 수 있다. 따라서 현재와 같이 공동주택의 하자담보책임 에 있어서 공동주택관리법과 집합건물법이 아울러 적용되는 상황에서 는 양 법률의 하자담보책임 규정을 종합적으로 고려하여 해석·적용해야 할 것이다. 그런데 2016년 제정되고 2017년에 개정된 공동주택관리 법에서는 입주자대표회의에 기존의 하자담보청구권과 아울러 손해배상 청구권을 부여하는 등, 종전의 논의를 넘어서는 새로운 입법이 있었고, 이에 대하여는 개정법에 따른 새로운 해석이 필요하다.
