The development of restorative justice, one of the most influential criminal policies around the world, varies greatly from country to country. In the case of France, which is covered in this study, its development was relatively inadequate compared to major European countries and Anglo-American countries, where restorative justice systems are an effective criminal conflict resolution mechanism. However, in France, a epoch-making momentum for the development of restorative justice has been prepared through the revision of the Criminal Procedure Act, and measures to revitalize the restorative justice systems are continuously discussed and practiced in criminal practice as well. This study examines the recent development and future prospects of the restorative justice systems in France, and tries to derive its implications for the development of the restorative justice in South Korea. We hope that this study serves as a basic data for legislative and institutional improvements which are essential for the vitalization of restorative justice in South Korea where it’s concept and mode of practice are not well known and practically deadlocked in spite of it’s various advantages and potentials.

전 세계적으로 영향력 있는 형사정책의 하나인 회복적 사법의 발전 양상은 국가별 로 많은 차이가 있다. 본 연구에서 다루고 있는 프랑스의 경우, 회복적 사법이 효과적인 형사적 갈등 해결 기제로 작동하고 있는 주요 유럽국가 및 영미권 국가와 비교해서 상 대적으로 그 발전이 미비한 실정이었다. 하지만 최근 프랑스에서는 형사소송법의 개정 을 통해 회복적 사법의 발전을 위한 획기적인 전기가 마련되었으며, 형사 실무적으로도 회복적 사법 제도의 활성화 방안이 지속적으로 논의 및 실천되고 있다. 본 연구는 최근에 프랑스에서 이루어지고 있는 회복적 사법제도의 발전상황 및 향 후 전망을 살펴보고 이를 통해 우리나라에서의 회복적 사법의 발전에 대해 갖는 시사 점을 도출하고자 한다. 본 연구는 회복적 사법의 여러 가지 이점 및 잠재성에도 불구하 고, 아직까지 그 개념과 그 실천양식이 잘 알려지지 않았고, 실무적으로도 교착상태에 있는 우리나라에서 회복적 사법의 활성화에 필수적인 입법적․제도적 개선을 위한 기 초자료가 될 것으로 기대한다.
