K-webtoons are gaining huge popularity not only in Korea but also overseas. But behind the bright side of development, there was also a dark side. In 2013, the damage to the writers began to surface, with the platforms signing an unfair contract for both copyright and advertising revenue for new writers. In response, the ‘Ministry of Culture, Sports and Tourism’ enacted and announced six "standard contracts forms for comics" in April 2015. However, even after the establishment of the standard contracts forms, unfair contract issues and unfair contract termination continued to occur, and the ‘Korea Manhwa Contents Agency’, along with the ‘Ministry of Culture, Sports and Tourism’, collected opinions to revise the standard contract in the field of cartoons and distributed the current "Standard Contract Form for Comics (2019)". There are six standard contracts forms for Comics : ‘① Publishing Contract, ② E-book Issue Contract, ③ Webtoon Installment Contract, ④ Copyright Delegation Agreement, ⑤ Co-authored Contract, and ⑥ Work-For-Hire Agreement for Comics". Despite these efforts, the lack of legislation still makes it difficult to find a clear law to embrace the webtoon industry, and it is questionable whether the current "Standard Contract Form for Comics (2019)" can serve as a sufficient guide to the rapid growth of the industry and the emergence of new contract forms. Now it's been a year since the standard contract form became available. At this point, I will review the content of the standard contract form and discuss whether there is anything to modify or supplement, whether the wording of the contract conforms to the current law, and whether it is not lacking for the changed webtoon industry.

우리나라 웹툰이 국내에서 뿐 아니라 해외에서도 크게 인기를 모으며 발전을 거듭하고 있다. 하지만 발전이라는 밝은 면 뒤에는 어두운 면도 있었다. 2013년, 플랫폼이 신인작가들을 대상으로 저작권 및 광고수익 모두를 회사가 가져가는 불공정한 계약을 체결하는 등 작가들의 피해가 드러나기 시작한 것이다. 이에 문화체육관광부는 2015년 4월 ‘만화분 야 표준계약서’ 6종을 제정·발표했다. 그러나 만화분야 표준계약서 제정 후에도 불공정 계약 문제, 부당 계약해지 문제 등 사례가 지속하여 발 생하였고, 한국만화영상진흥원이 문화체육관광부와 함께 전국의 만화작 가 및 관련 종사자를 대상으로 만화분야 표준계약서의 개정을 위한 의 견을 수렴하고 지금의 ‘만화분야 표준계약서 개정판(2019)’을 만들어 보급하였다. 만화분야 표준계약서는 ‘①출판계약서, ②전자책(e-Book) 발행계약서, ③웹툰 연재계약서, ④매니지컨트 위임 계약서(저작재산권 위임 계약서), ⑤공동 저작 계약서, ⑥기획만화 계약서’로 총 6종 이다. 이러한 노력에도 불구하고 여전히 법제의 미비로 인해 웹툰산업을 포섭 할 뚜렷한 법령을 찾기 어려운 실정이며, 산업이 빠르게 성장하며 새로 운 계약 형태가 등장하는데 현재의 표준계약서로 충분한 가이드의 역할 을 할 수 있을 지는 의문이다. 이제 표준계약서 개정판이 보급된지 한 해가 되어간다. 이에 즈음하 여 표준계약서의 내용을 검토하며 수정 및 보완할 내용은 없는지, 계약 서의 표현들이 현행법과 일치하는지, 변화된 웹툰 시장에 부족함이 없 는지 논의 해보았다.
