Due to the recent surge in the sea fishing population, although it is an act of sea fishing, the ripple effect is bound to be great. Therefore, it is necessary to regulate the actual crackdown on sea fishing activities so that the marine environment can be prevented from being destroyed and the fishermen can be used continuously. However, the protection and management of Fishery resources management is very poor as Korea's fisheries management focuses only on commercial fishing and overlooks the socioeconomic value of the sea fishing sector. In order to balance sea fishing with resource management and to effectively manage fishery resources for sustainable fishing, legal control over sea fishing is required along with regulations on a crackdown on commercial fishing. However, until now, the illegal activities have been regulated by the marine police in a passive manner. In addition, the government and local government officials who are mainly engaged in the prevention of illegal fishing and establishment of marine products distribution order for the protection and management of fishery resources are not able to crack down on the fishery control because of the limited authority. 최근 낚시인구가 폭증하고 있기 때문에 비록 낚시행위이지만 그 파급효과는 클 수밖에 없다. 따라서 해양환경파괴를 막고 어업자원을 지속적으로 이용할 수 있도록 이제는 바다낚시행위에 대해서도 실질적인 단속 규제가 요구되고 있다. 그러나 우리 나라 어업관리는 상업적인 어업에만 초점을 두고 있고 바다낚시 분야의 사회경제적 가치를 간과하고 있어 어업자원보호·관리는 매우 미비한 실정이다. 바다낚시와 자원 관리 사이에 균형을 이루고 지속가능한 어업을 위한 효과적인 어업자원관리를 위해 서는 상업적 어업에 대한 규제와 더불어 바다낚시에 대한 법적인 통제가 요구되고 있다. 그러나 지금까지는 불법행위에 대해 해양경찰에 의한 소극적인 자세로 규제 단속을 실시해오고 있는 실정이다. 그리고 수산자원의 보호·관리를 위해 불법어업방 지 및 수산물유통질서 확립을 주된 업무로 하는 정부 및 지자체 소속의 어업단속공 무원은 단속 권한이 제한되어 있어 실질적인 단속을 하지 못하고 있는 실정이다. 본 연구는 어업자원관리제도를 고찰하고 낚시어선업 및 바다낚시의 실태와 문제 점을 파악 분석하여, 어업자원보호·관리를 위한 바다낚시의 바람직한 관리방안을 모 색함으로써 불법낚시행위를 근절시키고 건전한 낚시문화 정착을 통한 수산업의 지속 가능한 발전을 도모하기 위한 관리방안을 제시하고자 한다.
