This study has developed and presented an evaluation system and guideline that enable inventive products with patents, utility models, and registered designs to enter the public procurement market smoothly through sole source contract. In order to examine the current status of the inventive product's entry into the public procurement market, the process of approaching the procurement market of technological development products was classified and reviewed according to the possibility of entering the procurement market. Based on this analysis, the institutional, legislational, and practical issues related to the entry into the public procurement market of inventive products were derived. After confirming that such cases are uncommon through a case study in which an inventive product is contracted based on the determination of replacement possibilities, this study defines the definition of alternatives for procurement of inventive products, and whether it is possible to replace procurement using the evaluation system development methodology. In this study, the replacement possibilities of inventive product was defined as "the possibility of the existence of a non-infringement substitute product in the market" and evaluated replacement possibilities based on the technology and industrial property rights applied to the product. For inventive products to actively enter the public procurement market, the detailed evaluation procedures and evaluation indicators presented in this study should be used as guidelines, as well as the active administration of purchasing contract managers in public institutions.

본 연구는 특허·등록실용신안·등록디자인을 보유한 발명제품이 수의계약 방식으로 공공조달 시장에 원활히 진출할 수 있도록 하는 평가체계 및 가이드라인을 개발하여 제시했다. 우선 발명제품의 공공조달 시장 진출의 현황을 살펴보기 위해 기술개발제품의 우선구매 조달시장 접근 과 정을 조달시장 진출 가능성에 따라 분류해서 검토했다. 이를 바탕으로 발명제품의 공공조달 시장 진출과 관련된 제도적, 법리적, 실무적 문제를 도출했다. 본 연구는 발명제품 조달 대체가능성의 정의를 규정하고, 평가체계 개발 방법론을 활용하여 조달대체 가능여부 판단을 위한 평가체계 및 가이드라인을 개발했다. 본 연구에서는 발명제품의 대체가능성을 “시장 내 특허 비침해 대체품이 존재하는 가능성”이라고 정의하고 제품에 적용된 기술 및 제품에 적용된 산업재산권을 토대로 대체가능성을 평가하도록 했다. 발명제품의 공공조달 시장 진출이 활발히 이루어지기 위해 서는 본 연구에서 제시된 세부적인 평가절차와 평가지표를 가이드라인으로 활용함은 물론 공공기관 구매계약 담당자의 적극행정이 필요할 것이다.
