Purpose : The purpose of this study is to examine the passing of risk that occurs when multiple carriers participate, and what seller and buyer should be careful about when entering into a sales contract. Research design, data, methodology : This study used the method of analyzing the related literature reviews. Results : In the Incoterms® 2020, the concept of multiple carriers was first mentioned, and according to this, the parties are well advised to identify as precisely as possible the point at the named port of destination. Conclusions : The buyer must write the contract correctly to prevent an unintended increase in risk. In particular, when multiple carriers are involved, the parties should be careful about the problems in which their interests become complicated.

최근 개정된 IncotermsⓇ 2020 규칙은 이전 버전과 비교할 때 개별 규칙의 삭제나 추가 등에 관한 변화보다는 개별 규칙별로 세부적인 설명의 추가 및 전반적인 내용의 편제를 사용자 위 주로 바꾸는 등의 변화가 있었다. 이는 Incoterms 규칙이 무역환경의 변화에 맞춰 실무의 적용 을 우선시하는 Lex Mercatoria임을 보여준다. 이에 본 연구는 IncotermsⓇ 2020 규칙에서 해상운 송에 사용되는 규칙에서 언급된 복수 운송인(multi carrier)의 개념을 검토한다. 또한 단일 운송 방식에서 복수의 운송인이 참여하는 경우에 발생하는 위험이전에 관한 고찰을 통해 매수인의 위험증가 문제 및 위험이전의 명확한 지점을 살펴봄으로써 매매계약 체결 시 주의해야 할 사 항을 검토하는 데 연구 목적을 둔다.
