According to J.S. Mill in his essay On Liberty, ‘the very simple principle' is that the freedom of an individual has the limitation not to infringe the rules related to the protection of his fellow creatures, individually or collectively. On this harm principle an individual can be punished. In the U. S. supreme court this harm principle has been a ground rule especially when it comes to the cases of freedom of expression. However, some scholars say that harming others cannot be a sufficient reason for interfering with the acts of an individual but a necessary one. As Mill's intention is to prevent the society or others from intervening in the acts of an individual, we have to consider the cases to apply this principle. Mill's emphasis on freedom of expression is based on autonomy. It is the most important thing to consider whenever we encounter some expression we hate or disagree with. I argue in this study that, based on Mill's liberty, freedom of expression should be protected in all cases even when one's expression of freedom causes harm to the interests of others. The reason is that freedom of expression is the only way to encourage the autonomy of individuals and defending it should be one of outmost importance in a society consisted of autonomous and responsible members. That is why I am against the prosecution of blogger, Minerva for “fraud". I insist that he is not guilty because he didn't commit fraud, nor should he receive any penalty even if he had done so. If we really want to be a responsible individuals, freedom of expression should be interrupted continuously neither by others nor by our society.

밀은『자유론』에서 개인의 자유를 강조한다. 그의 자유의 원리에 의하면, 개인은 다른 사람에게 해악을 주는 경우를 제외하고는 자신의 행동에 대해 간섭당하지 않을 자유가 있다. 이러한 밀의 자유의 원리를 근거로 하여 개인들의 자유는 종종 다른 사람에게 피해를 준다는 이유로 간섭당하곤 한다. 미국 연방 대법원의 판례를 보면 표현의 자유에 대한 사건의 경우 법리의 적용이 밀의 강한 영향을 받아 해악의 원리(자유의 원리)에 근거하고 있음을 알 수 있다. 그러나 밀의 『자유론』을 분석해보면, 다른 사람에게 피해를 주는 경우라고 무조건 개인의 행동이 간섭될 수 있는 것이 아니라, 간섭이 허용될 수 있는 필요조건이 될 뿐이다. 더 나아가 밀의 표현의 자유를 분석해보면, 다른 사람에게 해를 미치는 경우라 하더라도, 표현의 자유는 우선적으로 허용되어야 한다고 주장하고 있다. 간섭이 허용되는 예로 밀이 제시했던 옥수수 거래 상인의 경우를 보면 다른 사람에게 해악을 준다는 이유가 아니라 행위자의 자율적 사고가 가능하지 않다는 것이 간섭의 근거였다. 표현의 자유는 개인이 자율적 인간으로 성장할 수 있는 조건이고, 인간의 도덕적, 지적 본성의 성숙을 가져올 중요한 요소로서 절대 어느 상황에서도 양보할 수 없다. 따라서 연구자는 이러한 밀의 표현의 자유의 이해에 근거하여 2008년 후반기에서 2009년 상반기에 걸쳐 우리나라에서 표현의 자유를 둘러싸고 뜨거운 이슈가 되었던 미네르바의 검찰 기소에 대해 반박하려 한다. 검찰이 내세우는 “허위사실 유포 죄”는 기소 내용을 보았을 때 타당한 이유가 되지 못한다. 설사 검찰이 기소한 대로 공익에 해를 주었다고 하더라도 오히려 자신의 행위에 대해 책임을 지는 자율적 행위자로 성숙케 하기 위해 미네르바의 표현의 자유는 옹호되어야 한다. 지적으로 뿐만 아니라 도덕적으로도 건강한 개인들로 이루어진 사회는 스스로 판단하고 책임지는 자율적 개인들의 성숙을 통해서만 가능하고, 또 이것은 표현의 자유만이 보장하기 때문이다.
