Human right is universal to everyone. Despite such sense, human rights are confined or infringed. This study is to look into students' human rights problems with the cases where students rights are confined or infringed, especially the issues being raised during the discussions on enactment of Students' Human Rights Ordinance. Two issues are being raised. The first one is whether it is possible for students' human rights and teachers' educational authority to stand side by side. The other one is cons and pros of the corporal punishment. This study suggests that students' rights and teachers authority be compatible and corporal punishment be banned. In conclusion, it implies Ordinance of Students' Human Rights is a must to guarantee students' human rights.

한국어

인권은 모든 사람이 누려야 할 보편적인 권리이다. 이러한 인권의 정의에도 불구하고 인권은 제한되거나 침해된다. 논자는 인권의 제한과 침해 사례로써 학생인권의 문제를 살펴보고자 한다. 특히 학생인권조례 제정을 둘러싸고 제기되는 학생인권의 쟁점에 관해 살펴보고자 한다. 논자가 생각하는 학생인권의 쟁점은 2가지이다. 첫째, 학생인권과 교육권의 양립가능 여부이다. 둘째, 체벌에 관한 찬반논의이다. 논자는 학생인권과 교육권이 양립가능하며 체벌이 금지되어야함을 주장한다. 결론적으로 논자는 학생인권조례가 학생인권보장을 위한 필요조건임을 주장한다.
