The COVID 19 which has shocked and terrorized the world as well as began in late 2019, has brought various changes in our lives. For instance, the things that were less of an interest in the past are emerging as new issues, and there are cases where the preparation of a new system is required because the current system cannot respond. As such, COVID 19 crisis is calling for a change in the post-COVID 19 by throwing problems to solve to the world. In the field of the legal system, in particular, the issue of the conflict between public health and personal information protection about COVID 19 has emerged as a concern to the global as well as Korea. In China, public has been prioritized over the individual due to the traditional socialist culture in public hygiene prevention. However, the application of the law is not much different in China and Korea when the conflict outbreaks between the public hygiene prevention and the protection of personal information. In some cases, public hygiene prevention is given priority through the way of restricting the movement of individuals and disclosing collected personal information, which arise legal problems. Thus, it needs to be prepared for this. In this study, it analyzes the civil law on privacy rights infringement due to personal information disclosure for the prevention and control of urgent infectious diseases such as COVID 19, through comparing Korea and China. For the purpose, it investigates the related cases like coping with COVID 19 and leaking personal information, and then review the relevant policies and legislative conditions of both countries. Based on it, it reviews where priority should be placed in the conflict between public health and personal privacy rights when the emerging infectious disease such as COVID 19 occurs. It is expected that the study will be used as an important research data for the civil and legal protection of public health in the outbreak of COVID 19 as well as similar emergency infectious diseases in the future.

2019년 말부터 시작되어 전세계에 충격과 공포를 주고 있는 코로나19 사태는 우리 생활에 다양한 변화를 가져왔다. 이전에는 관심이 덜하던 것들이 새로운 이슈로 떠오 르는가 하면, 현재의 제도로는 대응할 수 없어 새로운 제도마련이 요구되는 경우도 있다. 이처럼 코로나19 사태는 모든 분야에 대하여 문제해결을 위한 공통된 과제를 전세계에 동시에 제시함으로써 포스트 코로나에서의 변화를 요구하고 있다. 특히, 법제도 분야에서 코로나19 방역과 관련하여 공중위생과 사생활보호의 충돌이 라는 문제는 우리나라는 물론, 세계적 관심으로 떠올랐다. 중국은 그동안 공중위생방 역에 있어 전통적 사회주의 문화로 인하여 개인보다는 공공을 우선시 한 것이 사실이 다. 하지만, 공중위생방역과 개인정보보호의 우선 법익이 충돌할 때 적용되는 법률은 한국과 중국이 그렇게 큰 차이를 보이고 있지 않다. 공중위생방역에 있어 때로는 개인 의 이동을 제한하고, 수집된 개인정보를 공개하는 방식을 통해 공중위생방역에 우선순 위를 두고 있는데, 이로 인하여 발생하는 민사법적 문제와 해결방안을 모색할 필요가 있다. 본 연구는 코로나19와 같은 급박한 전염성 질병의 방역을 위해 개인정보가 공개되어 프라이버시권이 침해됨으로써 발생하는 손해에 대한 민사법적 규정을 한중 비교법을 통하여 고찰하였다. 이를 위하여 코로나19 대처에 관한 한중 양국의 개인정보유출 관 련 사례를 살펴보고, 양국의 관련 정책과 입법 상황 및 민사법상의 법적 지위 등을 함께 비교 분석하였다. 이를 통해 코로나19는 물론, 차후 이와 유사한 긴급성 전염병 발생에 있어 공중위생의 민사법적 보호에 중요한 연구자료로 활용될 것이라 기대한다.
